There are a ton of reasons why Police can kick in a door without a warrant. My problem is with the search part. Cops can kick in your door and enter if they have Probable Cause. But, to search? I don't think so. Tell your friends to get a lawyer. I'm not saying they have reason to file a complaint or sue the department. But, it's in their best interest to educate themselves on their rights and also defend themselves against whatever charges were brought against them due to an illegal search. |

Your friend better be talking to a lawyer....they can not enter a private residence without just cause and backed up with a search warrant....

I am not a lawyer but.. they cannot do that, unless your friend was compromise in national security or associated to terrorist activity. I don't know you or your friend but you need to find out why he was arrested. Sometimes, previous court arrangements are made and if something is broken... then police may have the right to arrest him anywhere.
get a lawyer to help your friend as we all have the right to defense. |
