do? In Boston the police want to have citizens call in, and report a neighbor for possibly having a gun. That's all it would take,a phone call. Then the cops will show up at the neighbors house,with NO WARRANT, to ask to search it. You can refuse to let them search,but would you? Would you ever call on a neighbor?

Even if they ask politely, it would still be wrong for them to even ask me if I have a gun in my own home. I don't have one, but I still don't think it is right for them to ask. And, no I would never tell on a neighbor. *sm* |

They do not want to search your whole house for guns, They want parents to allow them to search their child's room for any illegal guns. Having said that, there is no way I would allow them to search anywhere in my house without a warrant. What I would do, is tell the officers I would conduct my own search and if I found anything illegal I would contact them. I support law enforcement 100%., it's just that I support the constitution more. |

The answer would be not without a warrant. We have the 4th ammendment right that protects us from unreasonable searches and seizures. This would be the reason for this right.
But they are asking, if you let them in, and they find something that isn't a gun but equally illegal you will be arrested and charged.
Oh and hearsay evidence from a neighbor usually isn't enough to get a warrant. |

A citizen complaining about a neighbor they believe owns a gun is not enough give cause for a search. Now, obviously if you give consent to search your residence, but it sounds pretty frivolous. Many people do own guns and have them registered in their name, which makes it perfectly legal. Unless we're talking about violent felons in possession, or someone with a cache of firearms, I wouldn't want to do those house calls. |

I would absolutely refuse. Last I checked, we still have a second amendment. If this is true, it is an outrage and should be stopped immediately. I'd bet they don't tell you that you can refuse the search when they come to your door.
edit - Dear half-wit, The second amendment is absolutely the issue. Why would they want to search your house for a gun if it weren't a second amendment issue. The search is voluntary, so technically the fourth does not come into play. Don't ridicule someone who is very likely smarter and more educated than you. It makes you look pretty foolish.

Where's your warrant? Last time I checked, the Fourth Amendment hadn't been repealed, and unless they saw me run into the house with a gun in my hand that had been used in the commission of a crime, then there is no reasonable cause to search without a warrant. |

The asker of this question, actually has the facts surrounding this "slightly" wrong. The city council (obviously with PD backing) are trying to pass an city ord that would encourage the parents of minors to cooperate with police by allowing the PD to search the rooms of known juvenile offenders and gang bangers for illegals handguns. Nothing to do with "reporting neighbors for possibly having a gun".
Not really a 2nd amendment issue as the putzs targets don't have the legal right to own hang guns, and its not an issue of having neighbors "snitching" on each other.
And before everyone gets po'd at the cops, tjhis idea was conceived by the community who are experiencing sky-rocketing levels of juvenile shootings. |

The last person I would trust is a police officer. No I would not let them in without warrant. Access law makes you almost guilty. No I wouldn't call a cop. I'd end up getting arrested probably. |

Police do not show up at your house without a warrant or probable cause and ask you to search your house for guns. They also would not respond to a call saying a neighbor has a gun. If the call was about an ILLEGAL gun, they might investigate. But if there was no threat or credibility to the call, they probably would not.
Can you refuse? Sure. But if you do, they CAN go get a warrant, come back and tear your house apart.
