If someone wants to get a protection order for someone (Pennsylvania) would they have to go to court in lieu of going to the police and I guess filing for one? Meaning that they couldn't just go to the police and say I want a restraining order fill out some paperwork and that be that?

You would have to go to the office that is responsible for filling out protection orders. You wouldn't have to go to court to get one, unless the order of protection is denied and set for a court date to possibly be granted. It's usually the office that goes to the judge and asks for the order of protection to be granted or not. You'll just need to figure out where to go in your community to get a request filled out. |

Where I live you go to the D.A.'s office. They ask questions and see if your situation fits.
You should talk to some people about whether your situation is appropriate for a restraining order. Read "The Gift of Fear" which makes the case that they don't work against someone who is dangerous: for example, if you were having a heart attack, would you hold up a piece of paper and say "this will protect me"?
You can call up a local domestic violence hotline and they'll tell you what the local laws are. However, I wouldn't expect a restraining order to really protect you. They might work against a law-abiding citizen. |

No i don't think they would have to go to court. I think it's a case of going to your solicitor to be honest. |

i live in carbon county, PA and i recently filed for a PFA against my abusive ex boyfriend. I had to go to the Jim Thorpe courthouse, go into the prothonitarys office, fillout the paperwork and wait till the judge signed it or denied it. In my case, they gave me a temporary PFA until my court hearing which was the following week. After the judge signed the papers granting me my temp PFA, i then had to take the papers to the sheriffs department (which was right down the hallway) and i gave them a complete discription of what he looked like and where they were most likely to find him. When they served him with the papers, he had a warrent for his arrest so they took him to jail right away. When you first initially file for the PFA...it will not go into affect until the sheriffs department actually hand delivers it to the defendent. |
