Go to flexyourrights.com it is a web sight hosted by the ACLU that tells you what to do in such a situation. The videos are very informative about such situations. I do not know why I got a thumbs down for giving a web site that tells you how to avoid your civil rights being stepped on by the police and the government. Looks like someone does not want you to know your rights.

There is no benefit to talking to the cop. He'll do as he pleases and bust you for disorderly conduct, failure to comply with orders or some other trumped up charge and ad resisting arrest on top of it. Asking the cop to not search the car would be like asking a Hells Angel why he doesn't get a haircut and ride a moped that uses less fuel. You'll get a beatdown from the cops or the Hells Angel. My advice is just take it and be quiet if you want to make it out of there safely.

What I did in the 60's was politely say, "officer I don't want you to search the car". I did not walk or move close to the officer or yell or even repeat. If the officer asked something I answered otherwise I kept quite.
I used to get stopped at least once a week. i lived in a rough area, I had a beard (only commie pinko punks had beards then) and I drove a foreign car (commie anti American).
I never had trouble but I wish Velcro would have been around since they kept taking my door panels off.
In the 70's I became a cop.

I don't have any advice but this happened to me. They came to my house and asked to search my car, I told them no and they kept asking in a louder and louder voice. (like they were trying to scare me) I repeatedly told them NO. They thought I threw eggs at a girls house, they kept looking in my car with flash lights and saw some crumbs or sand or something (probably nothing) and said that it was egg shells so they opened my doors and searched my car. After finding nothing they proceeded to search around my house and garbage. They found nothing. I should have thanked them for waking me up at 1 am and illegally searching my property.

The officer needs your consent if he does not have probable cause. If he does have PC, your consent doesn't matter.

I checked out the web site suggested above and it's awesome. read it kids because it's open season on you young ones. if they want to plant drugs in your car they can if you let them in it. i always refuse to get out of my car unless they get a female cop. generally they know not to push it.

please tell george I'd rather his awsome wonderful men not be heavy handed, and violent, especially not with young people. And certainly not in my behalf, i don't want blood on my hands. I'll sleep better then. thanks

I would advice asking the Officer why he is searching the car. It is not necessarily a mistake for the Officer to do what you described. The US Supreme Court ruled that an Officer may search a vehicle without consent or a search warrant if he/she has probable cause to conduct the search. So the Officer may have a valid reason to search the car but just not bothered to tell you.

If you are not happy with the traffic stop then you can complain later. I would not interfere with the Officer because you will probably wind up getting arrested. Fight it out in court or file a complaint later if you feel you were done wrong.

You will NOT win on the street. If you are right, you'll win in court though.
