If you have the keys, you are considered in control of the vehicle while under the influence.
For what the legal fees, fines and loss of your driver's license will cost you, it is better to set aside some cab fare, or find a hotel.

You need to hide the keys in the bushes near a couple of stone markers.

Many jurisdictions will find you guilty if you can exercise control of the vehicle, such as having the keys in your pocket.

Yes, but I'm sure in every state is different. I know someone in Ca that received one.

actually i think it varies by state. i'm pretty sure that in new york that's considered dui. not sure why though.

Yes. If you have the keys with you then you are still in control of the car. Better to sleep it off some place else.

Here in Wyoming, if you are in the car and have the keys to it, you are in control of the car and it is a DUI. The fact that you are asleep does not mean you won't wake up and drive off. Another point, how does the officer know if you crawled into the car after you got drunk or if you drove to where you are now parked while you were drunk.
Generally, if you are in the car, its keys anywhere near you, and you are drunk, you are DUI toast.

About the only way you'll be able to sleep it off in the car, is if you toss the keys. I don't mean drop them in the floorboard or
hide them in the glove box. I mean out of the vehicle, way out of the vehicle. Then you could not get a DUI, but if they want to be a "real butt", could still take you in for public intoxication,
and if they do that, also have your car towed......"WARNING,

Michelle DUI does not necessarily mean driving... we have a little box to check which states attempting to operate. If your *** is drunk even on a mower but you fall off trying to climb on you could be charged with DUI.

To answer your question it would be dependant on location, legally parked, is vehicle running ect...

Theoretically it is DWI (in North Carolina) if you are in under the influence of an impairing substance and have physical control of the vehicle (i.e. have the keys while being in the passenger area of the car). I have occasionally run across some drunk in a bar parking lot "sleeping it off" in his car. I'll usually talk to them and make sure they are okay and leave them alone. I think its kind of lame to arrest someone for DWI like that. But it does happen.
I have, however, found people passed out behind the wheel at stop signs and I consider those more then fair game.

you must have access to your keys,not only in the ignition but anywhere in your control you can be charged.....best solution is to lock your keys in the trunk,then put a trunk key in a magnetic key box under the bumper and go to sleep..wake up,retrieve your keys and go home...cops bother you tell them someone took your keys and are gonna bring them to you in the morning..it owrks...if you do like the answer up top says and put them in the glove box you will go to jail...

Nope, only if your keys are in the ignition. If I were you I would put your keys in the glove compartment, so if a cop were to find you, you can show them they were put up.

just sleep it off in the back seat or the passenger seat with your keys put up. that way it shows you werent even intending to drive the vehicle. if you were in the drivers seat they could try to say you probably passed out before you could start the car.
