Someone used my identity for something that ended up going on my credit report. To get it off, I need a police report. The problem is the person who did it is a family member and even though they wronged me I have no wish to see them in trouble with the law. All I want is it off my credit report. So if I file a police report, can I choose to not press charges or not have it investigated? Thanks to anyone who can shed some light.

Phil: How is it a "false" police report? I don't think you understand. I have to file the report and send it to the company where the account was opened. The company cannot go forward with getting my credit back unless I file the report and send it to them.

You cannot file a false police report. If you file a police report it is the person who got screwed out of their money or goods that presses charges. The police investigate identity theft but the resources they put into it depend on the resources they have available and what's a higher priority crime.

I had an identity theft, filed a police report, the goods were shipped to a known address, I don't think any action was taken but I got my money back.
