Question about a Class C Misdemeanor?

My 17 year old brother was arrested for Drug Paraphernalia which in Texas is a Class C Misdemeanor. Is there anyway that we can get this off of his record? Trust me, he is being punished but we have soccer scholarships coming up and don't want him to be excluded because of this mistake he made, as well a sin the future with job opportunities.

Can we still do all this without an attorney? We are trying to aviod having one if at all possible.

Hello Heather. Non disclosure will still leave a record that will show in any CRB that is run. Better than nothing, but not really helpful in long term.
One other thought that comes to mind. Talk to the attorney about deferred adjudication. I am not sure if this would be allowed in a drug paraphernalia case, it depends on jurisdiction. If he can get adjudication, he is pleading guilty and will serve a strict probation with plenty of UA's and drug rehab classes, but when it is all over and done, the arrest and conviction are expunged ( erased from all public viewing records).

Have his attorney ask the D.A. to non disclose the record.
If this is his only arrest, and he has been clean since, they should do so.
It is up to the D.A., but the attorney can ask the court to non disclose even if the D.A. opposes the motion. |
