Question for UK police officers!?

The answer is ........ you could go on your way, but not without some friendly advice. You would be stopped by every police officer that saw you. Its not a very bright think to do (as I'm sure you're aware).

In terms of issuing a fixed penalty (Â£30) for not being in proper control...... some of the advice you've been given is incorrect. There has to be some evidence that goes along you drinking or eating or reading (or whatever your'e doing at that time), i.e seen to veer or swerve or some other action that would emphasise you were not in proper control. Simply sat at a set of traffic lights drinking / eating / reading / putting lippy on is not enough.

Technically, your not in full control of the vehicle if you have something in your hand, you can be fined for eating drinking etc.

Yes. While drinking from a can, you can be booked for Driving without due care and attention.

just don't do it mate, its not worth the hassle, also you are not allowed to drink full stop, while drinking, alcohol or juice, all the best

What was that publicised case a couple of years back. A women was prosecuted for eating either a sandwich or apple. She took it to court and failed in the appeal. So the national newspaper photographed a copper driving away eating a doughnut. A spokesman for the cops said that Police officers are "specially trained" to drive with something in one hand (and we can guess what that is!!)

So if we can all undertake this intensive "driving one handed" course then when you need to scratch your nose, wind the window down, turn the radio up and stick your middle finger up to someone, we can not be done for driving without due care and attention. Otherwise, all the coppers are in the same boat as us.

Not a police officer but you can be fined for eating or drinking whilst driving. Remember a story from the BBC not to long ago about a man in Coventry being fined Â£30 for eating a biscuit whilst driving, so drinking a tinny aint gonna go down well i imagine.

You can be done for not being in full control - even stationary at traffic lights. Nothing to do with it being alcohol, I believe I saw a while ago someone done for taking a swig from a bottle of water at the lights. Someone must have been very bored!

We don't have an open container law in this country, your passengers can have a mobile party if they want!

No, you're not breaking the law at all. But I would advise you to put the can away, or have your licence ready because you will be pulled over by every officer that sees you drinking.

Does the UK have an open container Law?

If they do, then they can either cite you for this, usually with just a ticket or if you start mouthing off at them, claiming you know your rights, they can probably arrest you.

In most states in the USA, if you are driving the vehicle and your passenger opens a can of beer in the vehicle and a police officer sees the open can, I believe he can issue the driver a ticket. I do not drink, so I don't have this problem, and besides that, it would be sort of difficult to drink while driving since I have a motorcycle.

Why not call the local police department and ask the question to them, therefore getting the correct answer to your question, directly from those who are entrusted to enforce the laws.

personally i'd still arrest for drink drive to let the more accurate station intoximetre do the test the releasy you when i was damn sure you wouldn't kill anyone.

But apart from that i cant think of anything else.
