my husband got a DUI and when he went to court the judge said he
will have random urinalysis for 12 months. Does this mean he can't drink at all?

Usual terms of a DUI conviction/probation include a clause where the person must submit their blood, breath, or urine at the request of a police officer, probation officer, ETC. That means exactly what it says. An officer contacts the person and requests the submit to one of those tests. Failure to do so it a violation of probation.
Other special terms, such as a "no alcohol" clause, are usually only applied to repeat offenders. If this is a first time offense for him, I would doubt he can't drink any alcohol. All of his terms should be on his probation/court paperwork. Review them and know them well. |

Some people don't know the law. That's okay. Alcohol usually stays in your system for anywhere from 12 to 24 hours, depending on your metabolism. If your husband has fast metabolism, it will get out of his system quicker. What a random urinaysis means, is that they can pop it on him at any time. So for instance, you guys go out to a club and drink until 3am, then go home and go to bed. The judge pops a urinalysis on him at 8am... it will still be in his system. My advice would be... if he's going to drink, so it on a Friday night. All of the court systems I have been involved in aren't in their offices over the weekend.. so he'll be safe, as long as it's just one night a week. Other than that, he's taking a chance at getting his license suspended. |
