They have to let you contact your attorney if you've been charged with something. If you were charged and not allowed to contact your attorney, I'd consder looking into filing suit against the department.

If you are in their custody, there isn't much you can do. IF you ever get out, contact an attorney. Until then, keep your mouth shut.

Not enough information. How are they keeping you from doing this? If you have access to the internet, and are walking around, how can they prevent it? Are you asking for a third party? If that party s being held incommunicado, how do you know about it? If they got the news to you that communication isn't being allowed, then there is some form of communication happening.... Are charges pending? has there been an actual arrest? Is the party under 18? One possible answer is to get another prisoner if possible, to get a message out to a legal advisor.

I guess you could lodge a complaint with your lawyer after you're released and then decide where to go after that.

It's your legal right to contact a laywer if you are arrested... it is also your legal right to not answer any questions without a lawyer present.. if you are refuse a lawyer then keep your lips closed and wait them out..

I would remind them that I pay their salary, and that makes me their boss, and since they are doing an improper job I would fire them on the spot and walk out.

Good question! If you can't contact your attorney that pretty much takes care of the legal avenues! As far as family, are you related to the McCoys or Hatfields? Your only chance left is maybe whisper in the judges ear! A tear or two might help!

On the surface, it would appear that they violated your civil rights.
I would contact a civil rights attorney. However, the police have been known to stick together and claim they did offer it to you and you refused or maybe were drunk or under the influence of something else. Do you have any witnesses?

I don't know about refusing contact with family, sometimes that has practical or procedural merit (especially when the family is part of the conflict that got the police in between you and them), but refusing contact with a lawyer is serious, scary stuff. Perhaps your lawyer is a member of the family that the police have placed off-limits to you? Perhaps the lawyer is representing the family that the police have placed off-limits--in which case your lawyer, in this you would have to get another lawyer, and likely from another law firm as that may be applicable, would have to talk to their lawyer.

If a police officer is just being an, well, another word for an animal's rear end, then you need to talk to that police officer's supervisor or a judge--all of these are situations that find it incredible that you can make contact with yahoo answers but not your lawyer or family. Perhaps you are speaking on behalf of someone you know, even then the situation of your question is hard to imagine.

you have the right to a lawyer, sure. BUt you are right they might try stall tactics and stuff hoping if they stress you out you'll say something.

Remember anything you say can and will be used against you. SO say nothing.

They will try everything they have to scare you into saying something. THey will lie and say they have evidence they don't have. They will lie and say your friends and family have turned against you and testified against you. They can and do say anything and most of it isnt true. Some crooked cops will even pull out little baggies and say they found something in your car and toss it on the table, and you know that wasnt in your car but get convinced you are bing framed or something. You can't go by anything the cops say or do. They will lie like crazy to get you to say something. They cooerce false testimony from scared teenagers all the time.

ALl you can do is keep repeating your rights to yourself, just like they teach soldiers to only repeat their name rank and serial numbers. Just keep saying 'i have the right to remain silent..." repeat it until they go crazy.

If they say they have to hold you overnight or something just let them. Better for a night than for a lifetime. One of their favorite things to do is convince you if you say the right things you can go home, but if you exercise your right to remain silent they will have some sort of delay for an investigation, paperwork, or an appointment with a judge...so you think if you are silent you will be kept overnight.
So what. better a night than 20 years. Sit tight and REMAIN FREAKING SILENT!
its the first right they gave you. They can't take it away.
then keep asking for a lawyer repeatedly. Ask for a piece of paper. if they dont give you a paper tell them you'll write a statement. But when they give you the paper write on the paper "Friday Sept. 15, 1:12 PM I , Sarah Jones, hereby formally request to see my lawyer...."
then say " I have the right to remain silent" again. :D they will hate you.

All u can do is wait till u can contact somebody, then get a lawyer and sue the city and dept for like 500 million. That way you'll get like 50

Well depends on what state you are in but in florida by law they have to allow you too see your lawyer at least, every inmate has the right to go before the judge within 30 days of being arrested.
I would document every little thing on paper and not just in your head

it is a violation of your miranda rights and whatever they have on you legally cant be persued in court...."you have the right to contact an attorny if not one will be provided for you" if they dont let you contact your attorny you can say you killed someone .... give a confession.... but it will be inadmissable in court. that happened to my brother and all charges were dropped

i would refuse to talk until my lawyer was present. they have to let you call him if you ask for one. what can they do, really? beat you up? you'll file charges. kill you? i don't think so.
