The Officer has detained you based on Reasonable Suspicion so he can keep you there until one of two things happens. The first is he determines that you are not breaking the law (finds out you are old enough to have booze) and releases you. Or he develops probable cause (finds out you are under twenty-one) and charges you with a crime. So yes you have to answer. |

Yes you do have to answer or go to jail! Possession of alcohol by a minor regardless if you where drinking or not is against the law! Leave the alcohol alone that would be easier,booze just leads to problems! |

Cops have a sixth sense for alcohol and underage kids. He won't just ask you your age, he'll also ask you to prove it through IDs or parental verification. |

1- why are you carrying alcohol ? are you the delivery guy
2 - how did the store sell you
3 - was the bottle/alcohol visible
4 - were you with someone older then 21?
In any of the case the fact that a cop seen you with it and ask you for an ID, they are within thier legal rites to do thier job and YES you are answerable. -- not just that even an off duty cop can ask you ... or even a citizen arrest can be made as it would be under a illegal action. |
