This morning while driving to work, there was a school bus on the opposite side of the street. The school bus's red lights were flashing and the stop sign at the rear-end of the bus was out.
Obviously, the cars behind the school bus were stopped. I was driving in the opposite direction of the bus, saw the sign, and stopped. A car behind me didn't stop and went into the oncoming traffic lane (crossing the solid, double yellow lines) to go around me.
Did I do the right thing? Also, if the bus has no "stop sign" and its lights are flashing red, what is the official law (i.e. reference) regarding that? A lot of people don't stop for school buses when there's no sign and the lights are flashing. Most just slow down, but if I stand corrected, oncoming traffic should also stop when it's < 4 lanes, right? I just want to get this law down should the situation arise again.

The applicable statute is Vehicle Code section 22454, and is applicable only if the school bus has both lights and a sign. If the schoolbus is stopped to load or unload schoolchildren, and has its lights flashing and sign out, vehicles on the same side must stop. Vehicles on the opposite side must also stop unless it is a divided highway (one with barriers or open space between two roadways) or a multiple lane highway (two or more lanes of travel in both directions). Violation of this law will get you a $625 ticket.
BTW, the school bus driver can note the license plate of a person violating the law, report him to the police, and have a ticket issued later, so the guy who passed you might be getting an unwelcome letter.
I can find no law regulating the conduct of vehicles if the bus has only lights but no sign. Of course, an unsafe speed would always be unlawful. |

I believe you did. It is my understanding that you have to stop if it is a 2 lane road regardless of the double yellow.
Too bad a motorcycle cop wasn't nearby, the person behind you would have gotten a ticket that they would have regretted for a long time. |
