hypothetically speaking of course - but if i had commited a public order offence under section 5 and accepted an £80 fine - firstly does that mean i have admitted to the offence and secondly does it mean i have a criminal record. Do i have to disclose the above facts to my employer (i work as a teaching assistant) or any potential new employers.

If you were convicted at court of sec 5 POA then you would have a criminal conviction.
Likewise if you were given a police caution in respect of this offence then you would equally have a criminal record.
The good think about the fixed penalty notices that cover this offence are that if you accept one then it will not be recorded as a criminal record.... unless you don't pay it and end up in court.
So if you accepted the latter then you do not have a criminal record and have nothing to disclose. Whether it comes up on a CRB check I'm not entirely sure, but you wouldn't have a criminal record. |

The point of the £80 fixed penalty is to keep you out of the criminal justice system, so no criminal record..... BUT it does show up on a CRB check
also will show up on data request if you ask for one.
Moral plead not guilty and hope that you get found not guilty |

It is recordable. But it is mostly for minor stuff. If you have a job where you have to sign forms for a Home Office check own up. If not keep mouth closed. If you think is was wrong you can have your day in court. See the CAB. Dave |

If you paid a fine you accepted the judgement of guilty. I'm not sure of the level of the crime (traffic ticket), you can call the court and find out what it is considered. Don't go admitting things to employers that they don't need to know about. Not all people are understanding of the facts that people can make mistakes and that doesn't make us BAD or unemployable.
