there was a security officer outside my house about 30 mins ago trying to tow the vehicle of someone at my house visiting. he says it is a violation to park behind OUR cars and that she cant do that. she took the violation notice...NOT A TICKET...just something to let us know we are in violation of the parking situation and wadded it up and threw it. this piece of paper is the size of a check btw..he stated she hit him with it and he called the cops. he brought up the fact that he is african american (we are anglo american) and that she did it out of racial spite. she left to be sure she didnt get arrested and her car towed. is this legal? the cops never showed up here (even though we called them also) and he just left..out of nowhere he was just gone. is there anything i can do legally against him?

Is the parking area in question private property (i. e. owned by the landlord or condo association)?
Is the security officer employed by the owner of the property where the parking area is?
If the answer to both of the above is "yes", about all you can do is complain to the owner of the parking lot, and frankly I doubt it will go very far. In fact it could brand you as a problem tenant, so be careful how you approach it.
If the parking area is public property, unless the security officer is employed by the municipality you can complain to the police as it would be out of the security officer's "jurisdiction".

Legally? No. If it happened the way you say then one could argue its filing a false report but itâ€™s really his word against yours. You guys should have been adults and just taken the piece of paper and then spoken your home owners association instead of getting pissy and sophomoric.

Note this is without knowing what your home owners associations parking policies are and if you were in fact in violation.

Call the security company, demand they fire him or you will sue them. If they refuse, have your lawyer send them a letter of intent. Likely, they will fire the person on the spot.

Quite frankly, I'd have called the cops myself....and had them arrested for grand theft auto.
