She is sixteen-years old and facing 10 years is that right?

For Trafficking Exctasy first offence..no prior record for drugs.

She should get a chacne to get well I would think not be convicted and sent to prison. Everybody desrerves a chance first time around for making a mistake.

Update: The person who lived in the house has fessed up to having them, but now will all the others get of with a possibility of the charges dropped remains questionable.

X is a big drug that kills alot of people.... I think 10 years can teach her a lesson but I think maybe only 6 would be a better sentence.... Yes second chance are always nice bt once people get off and are back in the real world theynormally go back with in weeks so I think the sentence is a very good one

She had a chance to avoid prison time, DON'T SELL ILLEGAL DRUGS!

What role did she play in the drug ring, was she a major player? If so than it should help society to keep her away for a while. How many people were hurt by the drug she was selling? Consider that for a while, if she hadn't sold the drugs hwo many of her customers would have stayed clean.

She had a choice, and she chose stupidly. If she was only a minor player, than I hope she only gets a short sentence. If she was deeply involved in the drug manufacture and sale than she earned whatever the judge gives her. Keep it simple, obey the law.

Depends on how much E she had on her. If she just had a couple of hits then yeah I agree with you. If she is involved with manufacturing and distribution, throw the book at her.

Based on the information you've given, she is being charged as an adult. So there is MUCH more to this that a simple "possession with intent to distribute"..like you said though, trafficking.

She obviously was a major player.

If she is charged as a minor, she won't do the 10. At least not in jail anyway.

She was not busted for possession. She was busted for drug trafficking. That is a major crime and depending on what state you live in she could have gotten a lot more time.

What is "distribution"? What's drug "trafficking?"
Distribution basically means that a person is selling, furnishing or delivering a controlled substance. Distribution charges are often brought against people who try to sell drugs to an undercover officer or a confidential informant. Distributing controlled substances, including marijuana, is a Class B felony, which carries a maximum sentence of two to twenty years and a maximum fine of $10,000. Persons convicted of unlawfully selling a controlled substance on or within three miles of a school or university campus must serve an extra five years in prison without the possibility of probation. If a person over the age of 18 distributes a controlled substance to a person under the age of 18, the case must be treated as a Class A felony without the possibility of a suspended sentence or probation.

The offense of drug trafficking refers primarily to the weight of the substances involved and not to the movement of the drugs either across state lines or from one person to another. In fact, possession of a controlled substance may become a trafficking charge if the drugs weigh enough. It is not necessary for a trafficking charge that the drugs in question have been moved or transported at all.

Trafficking is a Class A felony, but the sentences for this offense differ from those ordinarily authorized for this range of felony. Depending on the substance and weight involved, a sentence for trafficking can range from three years in prison and $25,000 to life without parole.

Too many people say that someone made a mistake when they did something illegal. If she was selling illegal drugs, she didn't do it by mistake.
If she actually thought she was selling sugar but the bag contained drugs, that would have been a mistake. I doubt that was the case.
She knew what she was doing was against the law, but she did it anyway. She took a chance and lost. What else can you say ?

What does first offense and no priors have to do with it? Just because she hadn't been caught before means nothing. And if she doesn't get sufficiently punished, she will probably go right back to doing it.

I'm not big on incarceration for non-violent crimes.

I'd settle for 30 lashes or the equivalent, with home detention and probation.

How many people did she sell the drug to? How many kids are permanently scared because of her?
One person screaming don't prosacute me for this killed a bunch of people or made them brain dead. Should she get out with a slap on the wrist so next time she can kill a bunch of people.
I say when they are caught selling drugs they should be excuted.

She needs a fitness hearing to have her tried in family court as a juvinile instead of as an adult.

Frankly, I doubt she'll get 10 years on a Frist offense at 16. That's just what she CAN get. No one gets the max.
