Should I fight this ticket?

So, I was driving down a highway in Maine, and I was in the left lane following another car. We passed cars and I was waiting for the car in front of me to get over, they didn't. They waited longer than they should have to get over. When they finally got over I passed them (Going the speed limit and not even a mph over.) Next thing I know a cop pulls me over and says I riding to close to the car in front me. And he asks me, do you have your contacts in are they working? I say yes. I have to look all the way to the right so he can see that i have my contacts in. Then he says if I check your record will it be clean, no tickets or anything. Once again, the answer is yes. He says well, I can't pull you over for speeding so here's your ticket for following to close.

Now, I have been tailgated by cops before, and I get a ticket. I wasn't even that close to the car in front of me. I drive a black sports car with tinted windows. Do you think he was just looking for someone to get and he thought my car would give him something. And do you think I should fight the ticket?

well i think it depends on the cost of the ticket because if it's low then it might be more costly/annoying to go through the whole rigmarole of fighting the ticket. i say that if the fine is high, do it. cops profile, and since you were driving a sports car in the left lane he probably thought easy target. besides, you have a clean record.

You can, but usually in these cases the officer wins. Maybe you where too close or not, but i think you would have a hard time winning the case. In my state your windows can have only a certain amount of tint and the the officer has to be able to see you driving.

You should ALWAYS fight the ticket. It doesn't hurt to try.

For the record though, the fact that he wasn't going fast enough isn't a valid reason for being on his a**.

It has been established in court that in order to obtain a conviction for "Following too close" speed and distance must be proven. In cases of auto accidents, proof is readily available as the accident itself serves as such. However, in your case neither can be proven. Your case can be won on these grounds.

fight it, but theres a chance that without a witness being the fact that the cop is in the law enforcement, that the judge might favor but good luck if you do fight it! :)

your supposed to be 5 seconds behind the car in front of you. when you see a dotted line come from his back tires count to five and if that line made it to you before you hit 5 then your illeagal. this is actually a lot of distance in most peoples opinion but really it is accurately the safest minimal distance and you should try to keep that rule even when your in a hurry, but even i have broke that one a bit.

as far as cops who tailgate... it wont hold up in court, you cant bring every cop in mian to trail so forget it. you will not be aquited and it will just cost you even more money

The policeman probably did pull you over because of your car, but if he ticketed you for following too closely, chances are you were. When driving behind someone, you should remain one car length behind for each 10 miles of the speed limit (Example: If the posted speed is is 60mph, you should remain six car lengths behind). Unless you can prove how much distance there was between yourself and the car ahead of you, fighting the ticket will most likely be useless. Good luck!

Fight every ticket, everything to gain, nothing to lose
Did you see anyone swerve, slow down or speed up due to my driving,
If he cam from behind did he have a good view of the distance between the cars (it looks different from a distance behind)
was he looking for an excuse to pull you over, did he check anything else unrelated.
The last 2 times I was all prepared for a fight, and the cop never showed both times

chances are he was pulling you over because the look of your car appears as if you may have broken the speed limit or have multiple tickets against you already.

you should definitely fight it, you have a good chance of winning, i have one friend who got like 20 tickets in one month, and he only had to pay 2 because he fought them all (they were speeding tickets)

just try fighting it. tell them you can't really afford to pay the ticket because you have a lot of bills or whatever, so if they don't let you off the ticket you can at least have a reduced fee. it have also been because he was trying to meet his ticket quota.
