Should first time DUI convicts get jail time?

Just want to see what some consensus says about this. Should a person convicted of first time DUI get shackled and sent to jail? I'm not whining, believe me, just wondering. When I got one I went to county for 45 days and couldn't be out of my cell without shackles.

It's a serious crime. I think serving some time for this offense might be a "sobering" experience for the drunk driver. They may think twice before drinking and driving again. Forty five days sounds about right. It disrupts a person's life enough to be worrisome and gives the alcoholic some time to reflect...in shackles... |

Yes, I do. They should also be thankful that, that's the worst thing that happened... seeings an innocent person could have been killed and then they would have had to deal with that for the rest of their lives. |

only until they are sober. for a first time offender they need to be sent to rehab. then if they get more DUI's they need jail time. i went to the drunk tank back in 1998 for under the influence of meth. i spent one night in the drunk tank then i was sentenced to rehab. i finished the class and now i have no record, unless i get another 11550 under the influence. |

There are degrees of DUI depending on the level of blood alcohol, whether there was an accident, were there minor children as passengers , etc, etc.
Most states now require some jail time to drive home the point that impaired operation of a motor vehicle is not tolerated or taken lightly. |

Yes. I believe that every convicted dui charge should carry a mandatory 60 day sentence. I also believe that a convicted dui charge should also include conviction of attempted vehicular manslaughter, of which the first offense should be a mandatory 5 year prison sentence suspended for 5 years and a lifetime revocation of driving priveleges.
Second convicted offense would be another 60 days for the dui and a mandatory 5 year sentence for attempted vehicular manslaughter. If it has been less than 5 years since the first offense, then the two charges combine to a 10 year prison sentence.
Third offense would be a third felony, so three strikes your out - life!
Drinking and driving is soooo simple to avoid, and it is sooooo dangerous for the driver and everyone else on the road. |

1st offense in Oklahoma can get you a year in the county jail. Second subsequent DUI's are felonys and can get you put in the State pen. |

yo fool, u cant b serious. 1st dui. dat not b the standard 1st penalty. u didnt have an attorney. Shackles, dat b harsh for dui but u b knowin how the popo rolls. they b rolln dirty. They b haters. wastein space for a 1st time offender is mess up. jails r full of dui, and drug offenders. over half. time to cut em loose and arrest real criminals. everybody i know hates the popo's and has a major distrust and that why i b ridin dirty. |

Anybody who is stupid enough to drink and drive should be put in jail for along time and not be able to get out for along time. Think of all the innocent people out the that get KILLED by you stupid drunk drivers. If I were thr judge in your case you would not see daylight for life. |
