Should i fight or accept my underage?

Three other girls and myself went to a party and planned on staying there for the night. at about two am. we found out we had to leave. myself and the driver each had like two sips of a drink, not even equaling one shot, just like a sip tasting one of our other friends drink. the two other girls we were with were both drunk. we were driving back to one of the girls' houses to sleep when a cop started following us and pulled us over, there reason being the breaks were rusty? or something.. her car is very old and loud. after he told us why he pulled us over he said he could smell alchohol and asked if we had been drinking. the driver said she wasn't drinking, (for she hadn't been drinking besides the one sip and wasn't drunk), he asked her to come out and do a breathalizer. she passed and got a fine for being out past eleven since she does not have her senior license. next he called me and one of the other girls out and asked us if we had been drinking. i started crying and said yes i had one sip and showed him the amount i had dranken. he did a breathalizer but did not tell me my BAC. the other girl said she " had two " but refused to take a breathalizer and her parent came to get her? and she just got to leave but has a fine for being out past eleven. the other girl that was drunk took a breathalizer and was way over and failed. as we were waiting for all of our parents to get there i asked the one cop what my bac was - because i was sure if the driver wasn't over on her bac then there was no way i could be either, however i do have a very small figure and the driver is a little bit bigger than me. the police officer asked the other one what my bac was and i couldn't make out everything he was saying but i know he said " she wasnt -------- over but i could just smell it on her and she said she had a sip. " so basically i could've lied like the driver and said i didnt have that one sip and they wouldnt've known because i apparently wasn't even over my bac. i was completely not drunk and the time and the cops know that and even told my parents that.

also this is all our of our first offenses ever with the police. also i am 17 years old.

and let me emphasize the ONE little sip that me and the driver both had but she got away. and also the drunkest one there refused to take a breathalizer and got away (anyone know what will happen to her?)

So what are you asking?

17 year olds aren't even suppose to sip. You admitted to underage drinking. What do you want to know?

Underage consumption only requires one little sip. The legal limit for alcohol for you and all of your friends is ZERO, ZILCH, 0.000. You admitted to drinking which was your mistake. There is nothing for you to fight, it is a done deal.

Next time, say that you don't want to answer that question and that you don't want to submit to a breathlyzer. Both are well within your legal rights under the fifth and fourth amendments to the Constitution. As a passenger, you are not required to submit to a field sobriety test. Usually, a driver is required to submit to such a test.
