did you break the law? yes. even though it's a stupid law, the final matter is you broke it and got caught so no matter what your name is i think you should just say ok i shouldn't have done that and pay the money. |

Probably not.. the courts will probably just make the point of saying.. "thank you for helping us correct the spelling of your last name" and then charge you soon after that. |

i don't think u should have to pay and i think u have 40% chane and they hae 60% won't hurt to fight it |

Remember, most people here are passing off bad guesses as answers.
You can't get out of a ticket because of a typo. Feel free to fight it, yu will lose and then have court costs on top of your fines. It's completely amazing to me. You people break the law and then want to fight it because the officer made a mistake on the ticket. Doesn't work that way, dufus. |

Pay your fines, and move on. It's not like by him getting your name wrong it makes you any less guilty. |

I am not for sure about Canada, but here in the US about three years ago, my friend got a DUI and they got his first name wrong.. They wrote his nickname and he fought it and won.. It is worth a try.. screw it. |

You do have a good chance of being acquitted from all charges. If you have to appear in front of a judge he could still side with the officer. All states are different. You need to do your homework to cover all your bases. Check into the laws and see if a ticket is written incorrectly if it will hold up in court. This will give you a much better chance of fighting the ticket.
However, for all moral reasoning, if you know you are guilty you should pay the tickets. Even having no prior record. People who use the Justice System to their advantage are the ones who make it harder for the people who actually are innocent. And I'm guessing from the phrasing of your question that you are guilty of these charges. Otherwise you would have asked how you could have proved your innocence. Instead you are combating a flaw on a ticket. Good luck either way. |

Not based on his clerical error.
How did he know you were drunk? If he can't prove it and you didn't admit to it you may get off based on that.
Remember, it isn't illegal to smell like liqour, or act retarded or sick. He has to prove that you were drunk. |

I thin that the ticket is void if your name is incorrect. I'm not 100% certain but I recall a lawyer friend of mine saying that a couple of years ago. I think he got out of a traffic ticket that way. |

You should pay it. You were the one underaged and drunk in public, so what if the cop got your name wrong? They will still make you pay. There is no reason you shouldnt have to pay. |

i wouldnt think so, did he have your ID? |

Chances are he will identify you in court and you will then be cited for lieing on top of it and the fines will be worse. Best just pay the tickets and get it overwith
PS....no offense but if you even fight it they know you have the tickets and would not have gotten them unless you were the one charged, LOL |

yes call edgar synder and assoc.
seriously the policeman got your name wrong and if the ticket is wrong you can fight it |

Yer outta luck. |

The right thing to do would be to tell the police that they got your name wrong and ask them to change it. This would mean that you would have to pay the fine, but you shouldn't have been drinking in the first place. Good luck. |

Yes, unless somehow you can prove that was not you drinking. |

if you lied about it, i think that would make things worse.
if they got it wrong, then i'm not sure. |
|

Jimmy

no because they got all the rest of it right and if you dont pay it you will just get fined more but u could try to fight it. you could possibly win since you dont have any previous record of crimes but the name doesn't matter |

Clearly it wasn't me drinking, it was Stewart *Shows ID* I'm clearly Harding |

yes you do have a chance.. that is a huge mistake!! .. if they missed a letter or something that is one thing but to replace your last name with another person's last name?? that is rediculous...
now first i would suggest either speaking with a lawyer or getting a lawyer because they know more about the laws and ways around certain issues.. it may be a little expensive but it will help you keep those drinking violations off your record for applying to jobs or getting into certain school...
thats the last thing you want in todays time is to have a bunch of violations on your record because computers these days can do everything and know just about everything about every person..
FIGHT THAT TICKET!! and good luck.. its a shame that so many cops seem to forget their teenage years.. |
