I got pulled over the other day for my window tint being too dark but im a new driver and the dealership inspected it and passed the tint...so isnt it there fault because i had no clue? I have to go to court friday

You're actually responsible for the vehicle. You should try taking it up with court and telling them that you bought the vehicle like that. Remove the tint and take pictures of the vehicle and you can present that to the judge. The judge will see that you really don't want the tints and really take that into consideration. If that doesn't work then pay the ticket and take it back to the dealership and tell them that they sold you a vehicle that wasn't up to par with motor vehicles. Tell them that you want them to pay for it. We're talking about a ticket that's around $40, is it worth going through all that? Good Luck! |

The fact that you may have bought the vehicle with the tint already on there is mitigation not a defence. |

well, ignorance of the law is no defense. But you may have an out by going with the "dealership" angle. Don't count on getting off the hook easily tho |

Never go by what a car dealership says. They are salesman, and the car is sold as is. If it's a new car, the tint would be fine, but anything aftermarket has to be within the law. If the officer said it was too dark, it was too dark. Yes, unfortunately, you have to pay the ticket. It would wind up costing you more to fight it.

The law doesn't prohibit driving while knowing that the tint is too dark. Instead, the law prohibits driving with the dark tint whether you are aware of it or not. In some states the fine is carved in stone and the court has no discretion. In others, the court can reduce or increase the fine as it sees fit. If you are in a state that allows a fine of less than the amount listed on the ticket, then go ahead and try your explanation. |

Being a new driver has nothing to do with it. Not knowing if it was legal or illegal and not really being concerned about it being legal or illegal has nothing to do about it either! It's simple! It is either legal tint or illegal tint. Find out what the laws are about window tinting! If the dealership say's it's legal tint, then have it in writing and present that to the court. If that don't work then tell the judge you will correct the problem and bring it to the police dept. that issued you the ticket and have it inspected. Maybe they will wave the fine! Otherwise known as a fixit ticket. |

Definately go fight that one.... don't let the state make an easy buck for something as silly as that.
If it's standard equipment from the factory you'll more than likely win. If it's aftermarket (you might win) depends on the judge and how bad the locality needs the money. |

I agree about the dealership defense...also, if the court shoots you down on that excuse you may be able to get the dealership itself to pay your fines. They don't want to get litigated later for selling faulty / unsafe equipment. Go and speak to the general manager at the dealership and explain to him what happened. I don't know what state you're in, but every state has a limit on what level of tint you can and cannot have - find out from the dealer what level is installed on the car and take that info to court.
