I'm gonna make a long story short - my husband is going on house arrest and then probation for a dui... We were planning on moving at the end of our lease (aug 31) to the next county over (we live in butler county, pa... want to move to the city [allegheny county - pittsburgh, pa)
Now since the dui, we think moving is an even better idea, because of the public transportation in the city... should we try to get out of our lease early, and move before this all goes to court? or is it an option to move on house arrest or after house arrest when he goes onto probation?
obviously, we'll ask our lawyers opinion, but i'm really anxious to move out of this yuppy suburb we're in ( a couple steelers live in our neighborhood! )... its expensive and boring... and no public transit, of course.
I'd appreciate no negetive comments... everyone always seems so angry on here. just anything to help me figure this out asap - thanks!!

well i know that he'll need permission after he goes onto probation... thats why i'm wondering if it would be easier to just move now before it starts... i can't be stuck here for the whole probation... ugh.

This is something you want to discuss with your attorney before any planning. Judges issue sentencing and probation orders for the jurisdiction that the offense was committed in based on your info at the time of your husband's arrest. House arrest and probation are for the jurisdiction you currently live in. The judge has no authority in the adjoining county's jurisdiction. Therefore your husband will need to request permission from his future probation officer to transfer probation to a different county.
EDIT: Just because he makes a request doesn't mean it will automatically be approved. |

You definately won't be able to move while house arrest... You can move whileon probation if you get the permission from the probation officer... GOOD LUCK |
