Should the police be called about this matter?

My daughter recently broke up with her boyfriend. Out of spite (?) he returned a T-shirt to her that she had given him. He had ripped the shirt, burned it in places, and wrote the following message on the shirt with a marker:

"Click, kaboom (included a crude drawing of a mushroom cloud), 9 / 11, this is you, haha"

Is this considered to be a threat to her? The boy in question has had past problems with authority figures, school, etc. Should I take it to the police?

It probably is a bit ambiguous to be considered an actual threat, but it probably qualifies as harassment (a deliberate act intended to frighten or seriously annoy someone). She might be able to get a restraining order on that basis (depends on the law where you are) or to sign a complaint for harassment.

I think you need to weigh whether a report to the police might escalate things. Is there a history of violence? Has he ever threatened her with physical harm?

Whatever you do decide to do, hold onto the T-shirt and make notes about the incident. If something further occurs, the T-shirt would be evidence that could shed light on any further actions he might take.

You should without question get the police involved. This is considered a domestic violence incident. I would at the very least file a report. But I would also consider signing a harassment complaint, and depending on if she is in fear of him, get a restraining order. This is not normal behavior on his part.

You can go as far as you like with this, but considering he has a history of bad behavior, I would look at your options.

Some kids today are unpredictable, and I believe every threat can be taken serious. Who knows, this could blow over, but it's better to be safe and protect your daughter.

My advice, have the report taken at the very least. I'm assuming they boy is a juvenile. You could talk to a juvenile detective, if the boy is in the system, you have a better idea of how far you would like to proceed.

You could take this to the Police, but it is unlikely they can do much with it. Possibly some kind of harassment charge - but it doesn't really qualify as a credible threat. Tshirts don't blow up and it isn't likely he has access to any nuclear devices or terrorist organizations, so his words can't really be construed as a credible and present threat.

You could, however, use that shirt as a basis for requesting a restraining order. Such orders are issued by the court; contact them to begin the process. The Police only issue emergency orders in domestic violence cases, so you probably won't be able to get one from them (and it would be very temporary anyway).

Keep in mind that you aren't guaranteed to get a permanent restraining order; the court will also have to decide - just as the Police would - how credible the threat to your daughter is, and balance that against any harm that the person you were attempting to restrain would suffer from an unwarranted order.

You should not even question this matter. You should have already gone to the police. And, get the police to provide protection for your daughter. This guy needs mental help.
