So I go to court tonight for the ticket I got from scratching my ear?

The cop wrote me a ticket for talking on my cell phone, which I wasn't. I am bringing my cell phone records and my passenger along with his cell records as well so I can show the prosecutor I wasn't on my phone. Do you think my ticket will be thrown out? Will they try to charge me court costs? Will it be rescheduled so I have a trial? Whoever predicts the outcome tonight will get 10 points. Any advice would be appreciated also .

Hey Rock I guess I should have went into more detail for you. I pulled out of my driveway and was headed down the road. Three cars were coming from the opposite direction, The third was a cop. He turned around and pulled me over because he made a mistake and thought I was on my cell phone. I actually bought the video from his dash cam in hopes that I would be able to show it in court that I was not on the phone but you can't actually see in my car in the video. The sun distorted the windshield on camera. He only saw me for maybe 3 seconds tops.

I think you better make sure that there is no way the Judge can deny your phone records are falsified or doctored in any way.
I'm not sure how you could do that.
I think it will be more important for the officer to prove that you had a cell phone, and that he actually saw it up to your ear.
The burden of proof is on the state, all the judge has is the officer's word, which won't be taken lightly.
If you can directly question the officer and make him unsure of himself, you will win the case.
Ask him what color was the phone, ask him if it has any lights, ask him where the phone went, ask him if he asked for you to present the phone when he confronted you...
You sound guilty.
Scratching your ear sounds like a fabricated excuse.
Hands free is legal right?
What if your friend was on the phone, since he wasn't driving.
And he put the phone up to your ear for you to hear something.
That is like hands free.
You would not have broken the law.
Think about it, and be sure that what I said is accurate, by looking up the law.

Well, I don't believe you, so I'm sure no judge is going to believe you. Scratching yoiur ear takes a second and you had to have had your hand to your ear for a while for the cop to give you the ticket. I'm sure every person who gets this ticket says "I was scratching my ear." Remember when you fight a ticket and lose, and you will lose, you also get court costs added to your fine.

PS - was there a cell phone on the passenger seat? That's what they're going to ask. Where was your cell phone when the cop pulled you over? If it was visible and within your reach, you won't win. Every person who gets this ticket says "I was scratching my ear" so you're going to need a better case than that. The video on the car probably isn't going to make any difference because what's on the video isn't going to be as clear as what the cop sees and he's going to say "I saw him talking on the phone."

Well my boyfriend is an officer. He just graduated the police academy this October, so I'm pretty used to senarios like these.
I'm sure that once they see that you were not on your phone charges will be dropped. But that doesn't nessecarily mean that the Judge or Jury arent going to be ***** and say that you could have erased it and just make you pay anyways. But depending on how convincing you are, charges will be dropped. It's quite rediculous that he pulled you over for scratching your ear.
