What will be my penalty? I'm really afraid of getting points on my license.
It was 34 on a 25 (what was written on the ticket anyway...)

Show up at the preliminary court date and the Assistant District Attorney on duty should be able to reduce the ticket to a fee, court costs and NO points on your license as that is not outrageous. A good attorney could get some like that dismissed. There are no fees for appearing in court, you already have court costs assessed. Showing up is a good sign that you are taking these "charges" seriously. I had no tag, no license, no nothing tickets (I had out of state) and the A.D.A dismissed them all because I showed up and that everything was rectified. I won't guarantee that will be the case with you, but the courts are so bogged down with court cases, the counties are doing what they can. So if they can dismiss a case like a minor traffic ticket to court costs, a fine and no points, they will. They risk wasting money if you take it to trial (it's a criminal offense so its your right) and the cop doesn't show as a witness or you argue successfully that the speed can't be proven (bad radar gun calibration), or whatever. So you show up, the cases are good for fine (they want money), court costs (they want money) and no points if you ask. If you were doing 50 in a 25 i'd say no. But 34 in a 25 is not that bad. |

34 in a 25 isn't that bad. It's only 9 mph over the limit. He may have already cut you a break. Was it written by a state trooper or a local cop? Most likely you will get some points, but you may be able to plead it down if you have a clean record. Talk to the prosecutor and see what your options are. That is how it works in NJ.
