I drove through a sobriety check point this weekend and had a passenger in the car with me. How should a passenger behave in a situation like this? Should they talk to the police too? Should they repeat anything the police ask the driver, to the driver? Should the passenger ask the police personal questions like (Do you know Dave?)
The girl with me felt I was not intelligent enough to understand what the officer meant when she asked for drivers license and insurance and had to repeat pretty much everything to me. She also thought I moving to slowly etc. I have a CCW and was carrying. I wanted to make sure not to make sudden moves when taking my seat belt off and reaching for my wallet etc .

I told (or asked) the officer if I could take my seat belt off in order to get to my wallet. I was intentionally moving slow when I got my wallet. made it very easy for her to see it was 'a wallet' etc.

Anytime you are pulled over, the driver should be the primary point of contact with the officer.
Passengers should sit quietly and keep their hands visible. If the officer speaks to a passenger they should reply, politely.
Your passenger was out of line, and probably prolonged the stop for you! You seem to have been doing a great job during the stop.
When I have passengers in the car and I'm stopped (usually at an enforcement checkpoint) I remind the passengers that they should not speak unless spoken to, and to keep their hands visible at all times during the stop. |

As the girl involved in this incident I need to make things a bit easier to understand. I did not chit chat with the police. I did see an fellow officer that I know and made a comment to the driver which made the officer comment back to me. This comment was made after items were already with the officer and the driver was placing his id items back as slowly as he had retreived them. It was an unnecesary delay, and the police were trying to get us moving. The biggest problem is that the driver must carry his gun and I have repeatedly requested him not to in front of my kids. He never told me there was a gun in the car, or in my house. He may have the permit but also has been careless in the past. I wouldn't have been in the car had I have known. This explains to me why he was so nervous and did seem to have trouble retrieving the items requested at the checkpoint. He was not drinking so I had no idea why he was behaving so suspiciously. I was only trying to assist him, and move along. |
