Stopped by a cop,and was not ticketed.Months later he calls and said he has a court date! Do i have to go?

I was pulled over, and car searched. The cop found somthing that was not mine, and never seen it before in my life. (no not drugs or anything harmful) He took it, and said he wasn't going to ticket me. All the sudden, about 1 month later i start getting calls, nothing much happened there. 3 months later (yesterday) i got a call saying that he had a court date for me (tomorrow). I didn't get a ticket, nor did i get anything written in the mail, or a time for the appearance (over the phone) from this RCMP officer? Do i show up tomorrow, if there is no paperwork or tickets at all? What is he trying to do? Scare me? Help me out, i'm freaking out!

not only do i not know what time im supposed to be there, i can't get a hold of him or any lawyers, becuase it's sunday! yikes!

This does not sound right. You can either go to court and look to see if you're on the docket if not and you have his information you can report him for harrassing you; or you can
not show up and not worry about it , however, I think it is rather strange that he would have your contact information and you would have no documentation regarding the incident.

You need to go to the police department first and talk to his supervisor and find out what the heck is going on. You can also call and find out if you are on the court docket. Either way he isn't the one who is to contact you about anything concerning an appearance in court on the case. It could cause it to be thrown out if this were real. While you are at it, talk to the district attorney. The entire thing sounds fishy.

Call an attorney ASAP. And yes, go to court. If you're a no show you won't know anything more than you do now. And missing court dates can lead to warrents for your arrest.

Call the police department he worked for. Get a report on the incident if available. Also talk to a detective in your municipality. If something is going on you need to contact your local department and find out what before they issue a warrant on you.

first, call the police department and confirm. second, seek legal advice. try to reach an atty before the hearing or if you can't, ask for a court appointed atty.

i don't know about laws in Canada, but it sure sounds shaky to me! i would call the RCMP regional office and get to the bottom of it. if necessary, a lawyer will be required. hope i all works out for u.

By law you can be summoned verbally. You should go. And what was found in the car?????

you MUST go to the court hearing, or you may get in trouble. Make sure to say that you did not receive any ticket or follow up.

Chances are the police officer may not even show up in court. If you are not allowed to question your accuser, then your case is likely going in your favor

if you are required to show up in court, do so! you dont want to upset a judge!!
the officer could have 'filed charges' against you. sometimes, if the officer is uncertain of protocol, evidence, etc, he can run the info by the DA and then file charges against you if the DA feels there's sufficiant evidence.
the officer sghould have told you what courthouse to appear in so you will want to appear. if you had had more time you could have called the house to confirm your appearance.
this situation sounds like it's missing a bit of info, however, without seeing the officer's report it's uncertain what happened. you also have the right to contact the officer's sgt (or the supervisor to the repsonding officer) to get further information if the responding officer didn't answer your questions completely.

but, DO appear! don't upset the judge. if you fail to appear (FTA) you could get a benchwarrant issued for your arrest!!

A call to the clerk of the court will reveal if you are on the docket. It's that simple. If you are, then you better go or a bench warrant can be issued for your arrest. If you aren't, you should call and talk to his sargent, lieutenant, or captain. If it's bogus and he's calling you at home, you can then file an official complaint against him.

I am a cop myself and I know where I work you don't have to be ticketed to be charged. If the P.A. wants to charge you later they just do it through the state, its your responsibility to follow up on your actions. Is it FAIR no not really but it was your car your control so its your charge. A simple phone call could probaly answer your own questions.
