Theft under $5000, second offence. will i go to jail?

ok so this is my second offence as an adult. i am 19 years old living in b.c. canada.
first offence = theft from an employer.
i stole $3000 over a period of a week through false refunds. i did this in order to help a friend in an emergency... im my stupid head i thought it was a good idea.
i was never convicted because of restitution ( i paid back all the money in full, and they dropped the charges.)
NOW, about 7 months later, i was shoplifting at metrotown with a friend ( it was a sper-of-the-moment kind of stupid idea)...
i stole 2 hats from one store.. and a pair of sunglasses from the sunglass stand for my boyfriend.
(we did not know that we were being followed throughout the mall by an undercover security guard, who didnt see us actually "steal" anything, but suspected us because of our big purses.) ... we went into "old navy" and both took a few things. i took about 4 bathing suits and a pair of sandals from that store. we then tried walking out of the store and were tackled by the security gaurds. they took us into the back room and told us they saw everything and confiscated all the things we took. (including the hats and sunglasses) which i STUPIDLY admitted were stolen aswell.
my friend got to go since her record was clean, but since i have a record for stealing i was taken to the police station and given a promiss to apear and fingerprinting date.
i would just like to know what type of punishment is given for this type of thing?... since its my second offence and the first time was from my employer, i dont know how much more serious it will be..
what are the chances i will go to jail???
ALSO, would this be considered an "indictment" charge or a "summary" charge???
PLEASE HELP! im terrified!

also i have a youth record for stealing once at the mall with a friend. my parents were called and we got to leave. but that dissapeared when i turned 18. ...so im guessing that makes this MUCH worse... is this still a summary offence?.. and will this make my chnces of jail HIGHER? ..im not a compulsive shoplifter.. just tried it a few times, liked the thrill it gave me and didnt learn a lesson until NOW. i regret these things with my life! but there is no turning back now... i just want to avoid jail any way i can... i also have no money for a lawyer so i can only get a free one through legal aid. do i have a chance at getting away with probationstill with the youth record added? or community hours?...

you should go to jail. If you can't learn to pay for items, because things that you steal, the rest of us have to help make up the difference through higher prices. maybe you will think about the rest of us struggling to make ends meet and still have to pay for your admittedly stupid mistakes. |

I'm confused. You didn't get charged the first time because you pain restitution...but you have a record for shoplifting??
You should have learned your lesson. When I was 16 I was big into stealing at the mall (long time ago before all the camera presence.) I got caught one day by mall security and I was truly scared! Terrified! So terrified that (now here's a concept) I never did it again! I learned from my first time. You, on the other hand were let off easy the first time and didn't learn a thing for that reason. You need to get some time out of this. I suspect you will end up with probation though. Justice would be served if you got at least a month...or even ten days in jail. A wise judge might see your lack of learning the first time, as a sign that more drastic measures should be taken this time. If I were you, I would be scared too. And wise up this time. |

You get a lot of spur of the moment stupid ideas . Try this ... Call an attorney for a consultation .Maybe he/she can keep you out of jail .
The attorney will know what the chances are that you'll actually do jail time. |

Have you been convicted of the first offence? your first offence will most likely be referred to restorative justice.
Chances are you will get probation since you are a young offencer.
Theft under $5000 is a dual procedure but will only proceed as indicatable offence if involves theft of cattle (seriously) or if there is more involved. So, in your case, they will proceed by summary offence.
PS- stop stealing.
ETA- If you werent referred to the Restorative Justice Program, it was a formal caution (you were most likely a young offender at that point)
While I don't want to encourage you to keep stealing (obviously you haven't learned a lesson, you were cautioned, referred to restorative justice and still continued) it is very unlikely you will serve jail time at this point. I would say after this, you can expect to start spending at least the night or weekend in jail.
Most likely you will get probation. If you breach that, you will start serving jail time.
It will still be considered summary.
You are running out of options though. You have been warned (you will not be again), you only get one shot at restorative justice. If you are convicted this time, anytime after this will be taken more serious.
You are seriously screwing up your life over bathing suits. It is no longer a youth charge, this is on your record. |

I don't know if you will go to jail but it sounds like maybe some time in the big house would get it through your head that stealing is bad!
It is illegal. You can't do it. It's not allowed. It's a no-no. Don't touch if you can't buy it. Look with your eyes, not with your hands. I could go on but I am sure you get the point by now.
Being in the US I have no clue what will happen to you but I hope something scares you straight! |
