The kids were originally charged with battery charges. Two are 17 both females(being charged as adults) and the other 3 15 yr old males, The day before we went to court they changed all the charges to felony child abuse. We found out when we went to court. ALL 5 of them. The kid being "initiated" met up with these kids knowing he was going to get beat up. He was not severely beaten and had no marks on him and did not need medical attention.(He also met up with them after drinking at his house. The police report said he was happy to be in the gang after being initiated. (I think they all have lost their minds) The charges were filed 2 months after the incident. The police nor I had any idea what happened until my son told on himself. The kicker is I cant believe they changed the charges. I dont think the battery would have stuck since he gave them permission to hit him. I think thats why they changed them. I dont condone any of this but I dont think these kids should be charged with felonies. It was stupid on all their parts and they know that now. They are all still young and a felony will tarnish them for life. I think that A LOT of community service and fines would be sufficient. I have just been SICK through all of this and think they all have jelly for brains. Its driving me crazyJust inquiring on your thoughts.

The 2 17 yr olds are being charged as adults. My daughter is one of them. The courthouse told me the 15yr olds are facing felony child abuse charges.

As a parent, I can understand the confusion of all this and how the kids can think like they do, but I can also understand this from a legal point of view also.

I know it doesn't help, but when charges are first levied, the entire report goes to the District Attorney's Office where the entire case is reviewed. If the DA's office feels that a felony was committed, it is referred to the Grand Jury where a vote is taken. If the 25 men and women of the Grand Jury believe that it was indeed a felony, an indictment is returned and the charge(s) against the accused is modified accordingly.

In this scenario, it has nothing at all with the one rocket scientist who is willing to be beat up. This is strictly a matter of the ones who were willing to do the beating. That is what the charge and case is all about.

Best and only advice would be to retain a good attorney. He can argue the point that this was an initiation and not some kind of retaliatory beating. With a little luck, he may be able to get the charge downgraded if a plea bargain can be agreed to.

You gotta start breathing. These are juvenile charges, not adult criminal charges. An adjudication isn't going to destroy anybody for life.

It sounds to me like the kids were headed for potentially serious trouble. Even if they are "wannabes", look who it is they wannabe. No good would have come of it if they'd kept rolling along, with your knowing nothing about it.

Hopefully this experience will show them a little bit of the less glamorous side of the "gansta" life.

My own kid had a couple of brushes with the law as a teenager. He's now 22 and won't make an illegal U-turn if I ASK him to. The whole point of juvenile justice is to get kids straightened out before things get too out of hand. Give him emotional support, but you won't help him if you blame the cops for the fix he is in.
