3 DUI'S in missouri. has been clean for 30 monthes. wasn't driving. will my son go to jail or what. i am really upset with him.

In Missouri, 3 previous DWI convictions means that the next DWI charge will be a felony. And a chance of up to 7 years in jail.
A DWI conviction does not raise the open container charge to a felony, but does come into play when the judge sentences him. It raises the sentencing due to a clause called persistent offender. That is more than 2 priors in 5 years, or 3 priors in 10 years.
I don't know how old your son is, but I would suggest to you that he has a problem with alcohol. He needs help, try AA. The judge can sentence him to attend as part of his probation, but only if his lawyer petitions the courts for that ruling. |
