As a probation officer I can try to answer this question.

Technically its a violation of your probation to leave the state without permission. Why your PO has not granted you permission to go, is beyond me; however, I am certain there is a reason.

All is not lost though. Your best and easiest option is to go to your PO's supervisor and plead your case with them. If you are still denied permission, go to the chief probation officer, and if that fails then you could try to have the judge make a decision.

If you do leave, you run the risk of returning with a warrant for your arrest. If you are not a US citizen, you might have your residency or visa's revoked and find yourself barred from entering the country.

Whatever you do, understand that it's your choice and you will have to endour the consequences.

contact your PO for all that kind of information

If your probation officer told you that you cant go then don't. They wont know you are on probation. So keep your noise clean when you go. Go right after you see your probation officer so that you have 30 days to get back. If she finds out you will be sent to jail and your probation might get extended. Good luck to you. Hope I helped.

If your P.O. says you cannot go, then it is an uphill battle, but the battle is not over. . Have an attorney ask your judge if you can go. If the judge says NO then it is over. If the judge gets the feeling that you will go anyway, they might revoke your probation so make sure your atty does not mention that the ticket and passport are already in place or you will do your jail time now rather than later.

IF you go, you said you live here all your life but failed to mention if you are a citizen. Born here? If not, you will have more trouble coming back than leaving. In my state, Misdemeanor probation is administered by the county, it is not even a state thing. I do not think you will have any trouble leaving whatsoever.

Worst case scenario is that you may come back and get re-sentenced to the maximum jailtime allowable for your mis-deed. Misdemeanor is 364 days Having 4 months left on your probation when you violate in such a flagrant manner will have very little to do with how you are treated when you come back.

Write a letter to your PO and Judge explaining the seriousness of the situation and the helplessnes you feel. Stay in touch with them while gone, and promise to contact them when you return. (do not tell them SPECIFICALLY when you plan to return, or they will be waiting for you.) When you get back, turn yourself in. Do not make them come get you and if you show them that, they will go easy on you MAYBE.

Remember, You are planning to "diss" the system Big Time! They don't like it one little bit! Be as Honorable in your dishonor as possible and prove to them that they made the mistake not letting you go.
