Ok well I was charged with "Trespass property other than structure or conveyance" a few days ago because I was hanging around on land that was apparently private property.
Now, I have heard that there is a good chance that this can be a misdemeanor even though it is my first ever offense. And I technically was hanging around in a piece of land that was private property so wont I be convicted of the charge? And if this happens will I have to explain why I have a convicted misdemeanor on my record to any job or something else for the rest of my life?
So will this be the case all because I was on some land that I wasn't supposed to be on one day? I posed no threat to the land and got off right when I was told to do so.

No, we honestly went over onto the land because there were like 3-4 foot birds flying around and making weird noises around a spot so we wanted to go check it out. I know it sounds stupid, but its the truth.
And It was a big empty lot, like maybe used for cows or some farming, we weren't there for very long until a cop pulled up so im not really sure.

What state, were you doing something else besides just hanging out (is it criminal trespass?, and is this an empty lot, or someones lawn?

Do the words "summary offense" appear anywhere?
If you are under 18, you may have a pretty good chance. If you are not, then good luck. It doesn't matter if there are signs, you can pretty much assume that every single piece of property you will every see is owned by someone, so if it is not public, it's not yours, or you don't have permission- you should seek permission-

**** Ok, That's exactly what I meant.
So it does seem like a summary offense, NOT a midemeanor. basically, it's like a fine for littering or jay walking. You technically haven't ever been arrested, so you need not worry about furture job applications and this hurting you.

If is posted "no trespassing" then you're in violation, if you don't have the expressed written consent from the owner you are in violation, if the owner has a "trespassing affidavit" against anyone at the police department you are in violation, if you don't leave after notice was given you are in violation. This is a misdemeanor offense. |
