Underage, I'm not drinking at a party with alcohol, still illegal?

My friends wanted me to go to a party with them this weekend. People who are say 21 and up will be drinking, people who are underage said they wouldn't drink.
I don't drink, but I'm afraid that if I go to a party as a 20 year old I'll get in trouble.
I've heard that if I get even the slightest criminal record, I can't go to grad school in Canada. (United States: California citizen)
It's now become a sore spot between me and my friends, because I can't go with them to a party they see as innocuous.

Can anyone direct me to sources about underage drinking? Everything I read is about drinking and driving, and driving is not the issue here.

As long as it's not a licensed drinking establishment, you can be there. If anyone under the legal age is drinking, and the Police walk in, everyone is in trouble.
Use common sense.

Elsie, if you were at a party with your parents. And your parents were drunk and you were not drinking at all - you would not get in any trouble if the party was raided. If you are at a party where drugs are being used (cocaine -pot - etc) and you were not using but others were all would be in trouble if the party was raided. I say if it's just alcohol then not a problem, but if it is other stuff - stay home. And if you are worried about the consequences then don't do the action. I think you will never regret skipping a party - but if the worst happens and you lose grad school you will regret that for ever. -k-

underage drinking is what it is. if your under age and your drinking that is against the law. go to the party but don't drink. you will be fine. don't single yourself out from having fun with your friends. and don't let anyone pressure you to drink. if they do then leave. its your decision to do it

I doubt anything would happen...from my experiences, the cops break up the party and don't even bother with the drunkards (unless they're obviously too intoxicated).

But then again, I live in a college town where people get drunk practically every weekend.

Also, keep in mind, the drinking age is only 18 in Canada, so they might not see it as as bad as some would in the U.S.

As long as you have NO alcohol in your system and no drugs or anything else on you that is illegal you are completely fine. That means not even a sip of alcohol!!!

I don't believe you can get into trouble as long as your not drinking but if people underage are drinking they ones of age can be charged with getting acholo to minors.maybe if you want to still go you can just bring along some soda or somthing and maybe if your friends do drink they will need someone to drive them home. but in the end it is up to you,

dude there is nothing wrong with going to the party if you are 20. most clubs that serve alcohol let people in over 18, the just dont let them drink. you arent going to get a criminal record for going to a party. thats rediculas. didnt you ever have parties at your house where your parents drink? that wasnt illegal was it? not to mention you only have to be 21 to drink alcohol. you can serve it when you18 opened and serve it closed when your 16 under supervision. so go have fun. this idea that you will get a criminal record for being at this party where nothing illegal is happening is rediculas


im 18, i go to partys with my friends all the time as a dd. nothing wrong with this. its actually encouraged where the allow 18+

Just don't drink and you'll be ok. If the police show up, they'll probably be able to tell if you've been drinking just by your behavior. The worst that could happen (which is unlikely) is they will bring you to the station and do a BAC test. As long as you haven't been drinking it will come out .00 which means you won't be charged, no record. The odds of ending up at the station are very slim honestly, unless you mouth off or do something you shouldn't. Just have fun, be careful, and be safe.

well, you do not want to spoil Canada, or your friendships so......you could say u were the dd (designated driver) and if u dint have a BAC level or i should say a level of 00 then you are fine, besides know one going to check.

...you are legal as long as you are not consuming alcohol.

but hear me.

if you don't drink. don't go.

you will be/feel pressured to participate in activities *both* to appease those who choose to drink . (so that they will not seem/feel different from you.) and you will/may feel pressured to be one of the gang of partyers and so begins/continues the phenomenon of humans seeking social acceptance.

no small phenomenon. the police may be able to insight you of how many youth are participating in alcohol consumption by children/youth across the continent/country.

and it is disturbing.

drugs also.

unfortunately....western society in its' reach to be affluent had neglected to consider its' own youth until more recently. this is true across the board for the most part and it has taken years for the affluent and citizens to consider youth which had very few other forums for social integration/participation of their maturingness. so some had become more wealthy and influential to persuade youth what is/was right and good for them in the custom of a bottle of beer ....or whatever else.

one of the most disturbing down-sides of western society (and probably many other societies) and realizations is that men (and now women have followed .... to be socially accepted of course) without clear and articulable sense of self were/are susceptible to the activities and then behaviours of others which also had/have no clear comprehension of what is their personal vision and goals.

so please....with full respect. know why it is these people gather...(yes it is for fun and party...sharing...but the alcohol is incidental and facilitative...of pain and measurable pleasures).

it is good that you know who you are. but it is better that you can share who you are with others and be respected for this knowledge and seeming differences to others.

i believe by your openness and honesty you are well on the way to personal joy / success.

Well if you get caught they will ask you to take a Breathalyzer test and if you refuse you go to jail but if you do it and pass your good to go. Some other underage kids might mess stuff up and get in trouble but as long as your not drinking you should be fine. DOnt worry about school too much. Your Young and your allowed to do silly things. Canada may be different.

Not illeagal if your on private property. Come to think of it, it's not illeagal for you to be there.

2 things..one ...you can check your local underage drinking laws, and maybe talk to someone who knows about those laws....or 2...i go to party's all the time (im under 21) where there is drinking.. and the police have been called....all they have you do is take one of those test things. to see your alcohol level..if you havent been drinking, you should be ok

As long as you don't drink, you're not breaking any law by just being there. If it makes you nervous, skip the party. You'll have plenty of opportunity to go to parties when you turn 21. Have yourself a graduation party from grad school when you finish.

Too many people put their lives and the lives of others at risk with alcohol.

It's good to hear you're planning for your future. You are wise to be concerned about going to this party. If, say, there were to be a police raid, you could be in for a nightmarish four to six months trying to get it cleaned up. I wouldn't go, and if this interferes with your friendship, you may want to consider the wisdom of remaining friends with these kids.

Its technically not illegal but you can still get in trouble. I would definitely not go if it would mess up your odds of going to college @ a college you want to go to. If the cops show up and your there you can be arrested.

If you are under age then consuming the product is illegal

If you are present and not drinking you might be OK

If the police do not believe you and don't have what is considered reasonable time to perform a Breathalyzer then the charge could be made solely on the opinion of the police

I would hope most cops would not ruin a young persons life for this but it could happen and your putting caution to the wind - The cop you get might be in the middle of a divorce and just plain angry

As to admission into Canada from the US

They will take into consideration the charge and give you a chance to explain yourself - This would only apply to American or UK citizens and other Commonwealth nations Other places your out

I don't take the charge of under age drinking all that seriously

but

If the customs agent is going through a divorce as well as the cop you ran into - It could go very badly and there would be no legal recourse for you

It isn't like you could claim your fleeing persecution from the US
