You see how difficult it can be for the police to do an investigation & find out the truth.
They find alcohol at a party for minors, and no one wants to take responsibility, but maybe they can blame an innocent person.
People blame innocent people all the time.
They might blame someone who is unpopular.
They might blame some girl who refused to sleep with them.
The innocent person being blamed might have no idea why they got blamed.
For the police to make a case against someone, they usually need more than a bunch of witnesses, of which none are innocent.
I mean the people at the party who got drunk, they are not innocent witnesses. To convict someone, there is a need for witnesses who themselves are not obviously guilty of an equal or greater crime.
Hearsay is when someone says you said something.
Saying they saw you bring the alcohol is a statement of a witness, a false statement. |

if you were there they can get you for posession, but since you left the cops might realize that you didnt do it i mean come on, who would bring alcohol to a party and then leave? |

Essentially, you can be "charged" with anything. What they can prove is an entirely different thing. Given your account, I don't think they'd bother to charge you, since there is no way they can even come close to proving you brought it. Heck, without your admission, they'd have a hard time proving you were even there.
Your best bet is to stick to the truth. It's much easier to corroborate. |

As long as you didn't admit anything you should be fine. You didn't answer any questions without a lawyer present, did you? Cops don't care if you're guilty, they only care if they can pin the crime on you. NEVER answer any questions without a lawyer present, whether you actually did anything illegal or not. There are plenty of people in prison for crimes that they didn't commit. |

If you knew who "had" brought it it would be better for you. |

What ever happens, they have to prove that you purchased it.
They will want to ask you where you have been and what you was doing and when inorder to work this out. |

well if U did not bring anything or transport anything in ur car ur good. But if any1 tries to pin it on u and they all say it was u ...u might be screwed |

First they have to prove to brought the beer. second as long as you did not confess to it. all they have is another persons word. so stay clean and keep away from those people. |

"hearsay" is for court room purposes.
Cops can charge you for anything they wants as long as they have enought evidence (witnesses). |

Well have ur friend pull for u, first thing.
i really don't think it's that intense of a thing that cops will get severely serious..tell them that u didn't even really know who the people were and that u were framed.
idk if they'll believe u..but they can't just charge or do anything to u based on what people say. |

You`ll probably get the "lethal injection" Arthur ! I don`t see any way out for you !
Seriously .......... unless they can somehow prove that you brought the alcohol , I wouldn`t worry about it . If you`re 17 , you sure couldn`t have bought it yourself .
They`re accusing you , so the burden of proof falls on them . |

They'll just write you a citation for underaged drinking
Yes it is hearsay, but since they were at the scene, it can be admitted as evidence/testimony at a court of law
If what you say is true, nothing will happen or at most a citation for underaged drinking (which doesn't really matter)
Should the police question you then point out there is an obvious flaw in the police's logic...if only 3/5 people said you brought the beer, what did the other 2/5 people say? (If they said anything, it will be contradicting what the other 3 ppl said)
Obviously...unless 5/5 people said you brought the beer, you're not in trouble
So nothing will happen, you're perfectly alright. |

The simple and quick answer is no. But, your freinds really shouldn't be drinking underage, all sorts of problems can arise. The son of a freind of mine recently had a fit and almost died the morning after he'd had 3 cans of beer. The cause - alcohol. Be very very careful in future, young bodies and minds aren't ready for alcohol until adulthood. |

Nah dude tell them thats what he told you and they will get charged with lieing to a officer of the law :) |

First of all, I am glad you left the party with the alcohol. That was very responsible of you.
You'll have to wait to see if you are charged with anything.
A big thing in your defense is that you weren't there when the bust occured. Plus you would have your friends where you stayed the night to say you got there at 10:30 and weren't drunk.
It would be weird to bring alcohol to a party and leave early without drinking it. |

In hindsight, you probably should have avoided the party altogether. From there, it is a matter of sticking to your story. There would be little evidence that you ahd brought the alcohol. You didn't have any, so you wouldn't have touved any of the bottles, cans, kegs or whatever. You also were not there at the time the party was busted, making it a bit tough to prove that you actually ahd been there in the first place. They can perhaps charge you, but it is more likely that the police are fishing for information. They are accusing you as a way to get you to tell who did bring the booze. If they had evidence, you would have been charged, not questioned. |

Sounds to me like they can't take their punishment.Besides,if you brought the alcohol why didn't you stay at the party and get s*** faced with everyone else? Maybe you should point that out to the cops. |

Don't sweat it until the police decide what they are doing. It may blow over. Since you were called in for questioning, you might be smart to speak to your parents about what happened. You are a minor, and you shouldn't have been questioned without your parents knowing about it. If charges are brought against you, by all means get an attorney! You did nothing wrong. |

dont worry about it. if you didnt do it they wont be able to convict you of anything.
they need either evidence or a confession to convict you |

it doesnt say what country your in. i cant imagine this being a deal in england.im gonna assume your in the u.s but i have no idea. normally you are innocent before proven guilty, its your word against theirs, therefore there needs to be evidence that you bought the alcohol to the party.without this evidence its unlikely anything will happen. to be honest....whatever country your in the police should have better things to do to go around breaking up parties. |

well its 3/5 and u were there ...dont know that much but u better hope that u dont get charged.

Stick to your guns, if you get charged then you have a reason to hate the legal system!!!
I am sorry this happened to you! Good Luck! |

No you can't be charged. It was a misdemeanor and unless an officer catches you with the alcohol they usually won't charge you unless of course you admit to it.. IF and I do mean IF you are telling the facts then stick to your guns and if need be , call a lawyer. |
|

William

Law requires proof. They cant charge you off of hear say, however if Everyone tells the same story then its unlikely they are lying and the judge can rule against you. Especially if you admit to going to the place anyways since there was alcohol present. |

They didn't have any proof that you brung anything and your friends can be your alibi. |
|

Bad Santa

yes they can charge you with being in possession for the simple fact that you were present. when they question you they do it for your own benefit(if you tell the truth). if you cooperate you may get off without a ticket just because they will focus their attn. on the trouble-makers. im sure you learned a lesson though about being in the presence of illegal activity. |
