Last night I was driving home from a concert. I had not been drinking (thank God). As I was driving back, a clearly drunk girl darted out in front of my car when I had a green light. I literally came within inches of hitting her. I slammed on my breaks and came to a screeching halt.
I was wondering, had I hit her and killed her, what would have happened?
What if I had stopped, gotten rear-ended, and then hit her?
Just curious.

Having seen this sort of thing before, the answer is "it depends".
If you are squeaky clean, no priors, no alcohol in your system, and you have those witnesses to say that you were driving along in a safe and prudent manner when this girl ran in front of your vehicle, causing you to strike her, probably nothing. It is an accident, not an intentional act on your part. If the act is intentional, this would be homicide.
Now, if you have a BAC of anything over 0, a shady past, or the girl is the Mayor's daughter, you life will be really ugly for a while. And for that, we have council for the defense! |
