my boyfriend violated his probation..i was wondering whats the normal jail time for violating? we live in fl

Hello Lala. There is two types of violations. One is a TPV ( technical probation violation) which means he didn't follow the rules ( sanctions) of his probation. He did not break a law in this type of PV.
The second is a PV ( probation violation), catch all for breaking a law ( could be a traffic ticket or any offense where a person is arrested).
In either case, he is being held on a "no bond" hold in jail pending a VOP hearing. If it is for a TPV, they can literally let him sit ( attitude adjustment) for up to 270 days ( this is in Ohio). If he is being held on a new charge, he will remain in jail until he either goes to trial, pleads out or has the case dismissed. At that point, he will have his VOP hearing.
If he is found innocent on a new charge, his probation is usually reinstated. If he was found guilty or plead out, he will have his original sentence reimposed plus whatever time he was given off the new charge.
PS....If he is being held right now for a TPV, it will depend entirely on how he has been doing since going on paper. The more problems he has given his PO, the longer the PO will let him sit in jail before dealing with it.

It depends on so many things. Like what was he on probation for, which conditions did he violate, how does the court respond to these violations, how flagrant or serious was the violation, if it involved drugs, had he been offered drug treatment before?
The range of sanctions varies from a chewing out by the judge, all the way to revocation of probation. |
