I think it would be manslaughter and not murder as his legal team would go out to prove he was trying to rape the child and not kill her.

it shoulnt make any difference in my opinion. Such a vile act is in my opinion worse than murder and should be dealt with accordingly. There is no cure for such people. They should be kept alive whilst they are willing to give insignt into their sick minds then executed, slowly and painfully, preferably involving the crime they commited. |

if it happened in america then theres a chance he'll get a decent punishment as they are actually quite hard on rapists.
If its in britain(sigh) his defence barrister will probably claim provocation on account of what she was wearing. and he'll walk free.

It all depends on that the district attorney wants to do. They will usually try him for rape, child molestation, and probably manslaughter. The good news is the police will leak the charges to the prison guards and because inmates do not like those kinds of people. They will probably "turn him out" and make his life hell. If they do not kill him he will want to be dead. |

I assume it would be manslaughter because he didn't kill her at first. well he did kill her in a sense. these guys get convicted but they come out soon under good behaviour. in my opinion they should bring death penalty for these monsters! |

Maybe he didnt "intend" to kill her but he did intend to hurt her. Him being a big grown man and her being a small llittle girl injuries were inevitable. It wasnt an accident,it should be murder. A death due to a car accident should be manslaughter. Poor lil girl :( |

Depends... does murder require intent to kill? If it does, as much as it sickens me, I guess it's not murder then. But in any case, the sick b*stard has broken a number of laws in addition to murder/manslaughter. I hope that'll put him away for a long time. |
