Was this a really insane thing to do? Will I be in a lot of trouble with the police?

Was this a really insane thing to do? Will I be in a lot of trouble with the police?

About two weeks ago I was sitting outside a cafe having a coffee with a few friends. I had just bought a new car which was very expensive and is also a classic car so it's quite expensive to get repaired (it's a 1969 convertable MG). Anyway, I was standing around with my friend's chatting, and my car was parked accross the street when a woman in a Mercedes drove along the street and smashed into the side of my car and broke the wing mirror off and scratched the paintwork quite badly. Anyway, she looked out of her window at the damage she'd done, and then drove off!!!! So I ran across the street, jumped in my car and followed her, she got out of her car to do some shopping so I confronted her, and she said she hadn't done it. I was so angry. So later that day I followed her home and scratched up her car pretty badly with a nail. Unfortunately, she had CCTV on her property and the camera caught me doing it. I've got to go to court. How much trouble am I going to be in?

Firstly, a 69 MG does not cost that much to get repaired - even the bodywork is relatively cheap and there are loads of spares around.

Now as to your question, yes you are in trouble, as is she for leaving the scene of an accident.
You are actually in a worse position because your offence could be classed as criminal damage.

All you had to do was get her registration and report her to the police and claim on your insurance.

You can expect a court case and a large fine.

Yiu're right. it WAS a dumb thing to do. You should have just gotten her plate #, a description of Her car(A cell phone photo, if You had one) and, filed a police report. they would have charged Her with the accident AND, leaving the scene of an accident. now, You are in almost as much trouble, as Her.

If you live in the UK you have been caught with irrefutable evidence of damaging somebody else`s property and must pay the penalty.
You have no proof this other women hit your car and you took the law into your own hands rather than report it to the police.
The claim you make will be ignored and the court will fine you like any other common criminal.
And of course, the other motorist got off scot free and a nice new paint job.....and you get a criminal record and a fine and damages.

Trespassing, destruction of property, pretty severe. Next time just jot down her plate number and call the cops,

Honestly, if I were you I probably would've done the same thing. That's happened to my mom before, a week after we bought our car. :(

The law is on her side unfortunately.

She has solid proof, and you have a mangled car.

Although I in no way condone what you did, in honesty, I think most people would want to do the same to others if they did something to your own car.

But yeah...you have to make a case.

If you haven't got a lawyer yet, get one.

As I said, she has solid proof of what you did, but you don't.

What you need to do is build a case on your side. Get your friends as witnesses, take photos of your own car. See whether your can get CCTV of her smashing into your car.

All of these things however is something a good lawyer would tell you, so my advice is simply to get in touch with the legal services.

Regarding to whether or not of the outcome of the case, you'll likely be fined and have to pay compensation. If it really swings in favour of the other person, then perhaps a suspended sentence/jail time or other punishments may be in order.

And if you build a decent case, you'll both likely end up paying each other, and if it swings in your favour she could get similar punishments to yourself.

She is more likely to have her license revoked or things like that though, for dangerous driving and stuff.

Well you can tell them what she had done and take pictures of the car you on the other had you missy are going to get a fine for tresspassing shes going to get a fine too i dont know what for but your the one who is in more trouble because you had done it on purpose not as a mistake but that lady could also get her licence suspended for bad driving your probably gonna get a warning

Eternal Empire
If you live in England you'll probably just get a warning, just act like you didn't mean to do it and your emotions got the better of you and you're sorry. You could probably beat someone black & blue over here and get away with a warning...

I don't blame you, if someone hit my car and it was brand new, than screw messing their car up pretty badly, I'd mess them up pretty badly. Especially if they drove off.

Be honest girl. Trust me.

Lying gets you nowhere unless you're a damn good Lawyer.

Tell them what you saw, you were frustrated and let your emotions get the best of you.

They WILL pick up on your honesty!!! Once they know you were honest about the scratching they will know you were honest about her hitting your car.

As for the trouble, it's hard to tell. Depends on your age, if you have a record, your witness's, etc. Build a case for yourself. Don't be deceiving. For admitting and apologizing to the lady but telling her she wasn't honest with you about her hitting your car, should cause her to feel guilt. Everyone feels like that when someone steps up, is the bigger person, leaving them feeling small.

But this is what I would do. Do what your gut tells you....I already know you don't want to lie.

ps// I'm going to be going to court soon too with issues relating to my landlord. I know they are in the wrong and they are lying up one way and down the other, but honesty and a smart boyfriend is going to win me this case. I know it.

Response to Lee - Suspended Sentence? Nah, don't think so - unless damage was aggravated in any way i.e. breaking into garage.

Yes, the response was wrong - you know that yourself. Court may decide you have inappropriate thinking/coping skills and may give you intervention as a sentence. Without knowing the full case and a biased view this sounds more like a conditional discharge - especially if you can get evidence against her. A CD means you can't commit any other crime in the period they give (say, 12months) if you do you'll be sentenced for the new one PLUS this one. Saying that, you did intentionally follow her home which is an aggravating feature which the prosecution will pick up on - be prepared. This won't be cheap...
