I was in a car accident not to long ago she purposely slammed into the back of my vehicle and got in my face and called me everything under the sun. What charges can i press against her? I went to the hospital for bad wip lash. It was the back end of my car, its a 1992 oldsmobile and its hard to fix because it was my trunk. I know she did it out of anger but what charges can i press?

The high way patrol was there and just took an measure-ment on how far she slid and stuff like that but I mean can i charge her with verbal abuse and hurassment stuff like that how far can i go with it? (MY CAR WAS PARKED KEYS WERE IN MY LAP) She could of avoided it but she didn't?

No. Its not harassment for a person to yell at scream at you and call you names unless it is a constant thing that occurs more than once and after the person is being told to stop. She did not commit a crime by verbally yelling at you.
Also, you would have to be able to prove she intentionally hit the back of your car. She may have been able to avoid you, but was she preoccupied with something else that caused her not able to see you? You can't use the evidence of hearsay, which is to say you think she intentionally hit you. You have to have hard evidence that it occurred purposely. |

Well other than suing her to pay for the hospital bills and the cost of the repairs, there is nothing else you can do. Unfortunately, you will have to pay for the things upfront and then wait for the case to play out. |

You can't press any charges on anybody. Only a DA can file criminal charges against somebody and only the police can investigate crime. If they were there and didn't find any criminal act afoot you can do squat. |

Lot of things need to be answered:
Was an accident report filed?
If the police were there did they witness her saying these things?
Most accidents are civil affairs, it becomes one insurance company versus another. There can be criminal charges but that is usually if the other driver has been drinking or has struck another person and or vehicle and left.
My advice..let the tounge lashing go, focus on the accident. Call your insurance company. If you dont have insurance, then fixing your car is on you and good luck trying to get the woman that hit you to pay up. |

Did you not call the police? They will handle your case. if you haven't filed a police report you need to do so asap. It will be really hard to pursue this on your own with out the help of law enforcement. |
