it is classed as assault report it he will be arrested and charged with ABH if this is his first offence he will receive a caution but the good thing is he will have a criminal record his photo and DNA will be taken

This offence can vary from assault to attempted murder.
Sounds silly doesn't it?
If the offender is carrying a fatal disease and he knows this then the charge of attempted murder could be placed even if he didn't know how the disease is passed on.

Spitting on another person is an act of battery. So is blowing cigarette smoke in another person's face. Battery involves unwanted physical contact. This contact does not need to mean contact with your fist. Contact occurs whenever you willfully cause a substance to impinge on another person's body without their consent.
The police will not be interested because it is not a criminal matter in which they have witnessed the offense. So you should consider bringing a civil suit. To do this you will need to put a money value on the injury done to you.
You probably will not win. Such cases are hard to win, and therefore few lawyers are willing to take them on if you plan to pay his fees on a contingengy basis. But by bringing suit, whether you win or lose in court you will give the offender cause to change his behavior - and that's your victory.
Nobody should passively remain docile if somebody spits on you or a smoker blows his filthy stinking smoke in your face. The law is there to be used and you should use it and stand up for your rights. |

Calling the police is a good answer. However, the law should be if you are spat upon you have the right to beat the perp senseless. |

It's a minor assault, class c assault in Texas, which basically is equal to a citation (class c misdemeanor). |

Do not delay in reporting this incident to the police. You should have phoned them right away to get a 'crime number'. Once this has been done you can go to the fuzz shop and make a statement.
Spitting on another person is a criminal offence in England and is classified as a kind of assault. Spitting in the street anywhere in England is also an offence punishable by a fine.
You can also take out an injunction to stop the person or persons ever coming near you again.
If a person follows you about 'stalker' you can have them stopped by simply reporting them to the police. If you know where the person lives, so much the better. The police will explain the 'stalking law' to them, which in effect means they will get no further warning and if they persist in 'stalking' you, they will be arrested and given a criminal record and may in some cases actually be sent to jail.

Depending on your state, it's either an assault or battery. I know in CA if someone spits in your face, it's a battery. |

legally this is treated as common assault, unless the person doing the spitting is HIV positive, then it is classed as attempted murder. If the saliva landed on your clothing then keep the item of clothing as it will provide DNA evidence. Its nice to know that the mother had such good control over this hooligan!! |

Anyone who spits on me "WILL" wake up in hospital with people wearing white coats looking down at them.

Technically, it is assault. If the teen has a known disease, it could be assault with a deadly weapon. Otherwise, it's disgusting. If the mother was there, she should be charged with being stupid......... |

In the U.K. it would be classified as either Common Assault or possibly Threatening Behaviour (Section5 Public Order Act). If the offender had no previous convictions and he admitted the offence he would be elligible for a Reprimand.
Most yobs see this as being 'let off' so its pretty much a waste of time, although it does mean that if he committed further offences he would be elligible for a Final Warning.
Then there's things like ASBO's and ABC's and a whole raft of similar things all designed to prevent these little ****s from ever being punished for their behaviour.
If he's under 10 then he's below the age of criminal responsibility, so nothing will happen. |

Spitting on a person is a form of assult. You can go and file an assult charge against this person. Now days , with disease's and etc., spitting on anyone is a true form of assult. |

"by the offenders actions whether intentional or reckless, puts another in honest fear of immediate or unlawful violence"
If you can say that you honestly felt at that time the spitting was aprecurser to violence, or it put you in fear (not actuall ooh im scared fear but fear in the vroader sense)
that violence may be used againts you.....
Its an assault.... and as such you have the right to immediate self defence under common law and the human rights convention.
However dont forget that you may at some point have to justify this to a court in front of a snotty jumped up defence solicitor.
