A lawyer is a lawyer.
There are hundreds of fields of practice (criminal, personal injury, real estate, business, etc). It generally breaks down into two types: transactional and litigation.
Litigation includes civil and criminal. These are the attorneys most likely to see trial. However, there are many litigation attorneys who never go to trial, for various reasons.
Transactional generally describes attorneys who draft documents (wills, contracts, real estate, etc) and who rarely see Court.
There are also attorneys who specialize purely in dispute resolution and negotiation.
Judges are either appointed (by the governor, president, etc.) or elected. There are no specific requirements to be a judge candidate, but expereince in law is generally helpful. |
