What are the laws regarding child custody?

i have 2 kids and i have custody of them, my ex husband has supervised visitation and he had the kids this weekend.. he picked the kids up and took them to his house now he says that he is not bringing them back that he is keeping them.. what can i do? i called the cops and they say that i need to go to the town he is in and go to the police station there.. he lives 3 hours from here and i have no way to get there..

he has supervised visitation, the papers say that it has to be supervised by his mother bdecause that is the person that i picked.. his mom came with them to pick them up.. i can find a way to the town that they are at but i have no idea where they are.. the police told me to stay here and file a report monday through the clerk of court but i dont want to wait that long

There are several things you can do:
1) call that precinct/police station and report the kids as being kidnapped, he doesn't have full custody so he shouldn't be able to get away with not bringing them back. These are you r kids you have to find a way to get to the station. Ask a family member for help if need be
2) call children's services and make them aware of the situation, if he lives 3 hrs away he is neglecting their education, how can they get to school from 3 hrs away everyday?
3) Go back to court ASAP and make a motion for violation of the custody agreement.

It is kidnapping. Why in the world would you allow your ex to take them anywhere considering that he has only supervised visitation? Which means that either you or another adult such a visitation monitor has to be present. File kidnapping and interference of child custody charges with your local police and district attorney. They can act but they will likely question you as to why you allowed him to take the children out of your sight. You don't have to go to his town, but you should just in case find any way that you can to get there. He had no right to take them out of your presence for any reason. Find a ride there, no matter what, these are your children.

If there is a custody agreement he just broke it. Take him to court for it. You really need to find someone to take you to his town and the police there. A question, do you have full Legal custody of them or do they just live with you full time?*

You need to contact the police in that area ASAP. Obviously you have internet access; look up the number. According to the law, those children are kidnapped by their noncustodial parent and the police can and should be involved.

Incidentally, if he is supposed to have supervised visitation, why is he allowed to take the children? Where is the supervision?

i am going through the same thing with my ex he showed up at my home last night and because he knocked on the door and i opened it an let him say hi to my children... which i turned around for one minute because my 7 month old started crying he kidnapped my 2 yr old the police department wouldnt lift there finger to help and i have full custody.. they said call your attorney
