Is it a felony or misdemeanor to get caught with marijuana in a Philadelphia county prison? It was a small amount. What may be the maximum penalty and the minimum penalty ?What may be some of the consequences for someone who has reached their max out date but got caught with a small amount of marijuana and is still incarcerated and waiting for their trial date for the new marijuana case? Will he get sent back up state? Will he have to do a lot more time?

Well the same as having it in the rest of the state plus having contraband, transporting contraband etc. Get the picture? VERY dumb stunt to pull. Depending on his criminal history it might become a felony where he could do some major time. |

It is a felony no matter what the amount, they will probably stayed locked up and there will be more time added to what he has, yeah he will probably got to state cause it is a federal offense. as for the more time that will be up to the judge to decide. And because it was in jail that he committed the crime they probably wont go easy on him. Hes supposed to be there to learn a lesson but if hes dumb enough to do that then he deserves it. |

It is a felony in most, if not all, states to possess marijuana in a correctional facility.
In my state (TX), it's a third degree felony.
Its going to get him more time in prison, you can count on that.
I'd guess 5-10 more... unless his prior charges were drugs, then it could be 'enhanced' and he could get up to 25 years. |
