Miranda rights- Before a law enforcement officer may question you regarding the possible commission of a crime, he or she MUST read you your Miranda Rights. He or She must also make sure that you understand them...... Compulsory confessions will not constitute admissible evidence unless suspects have been made aware of and waived their "Miranda rights".
In case you dont already know in the event you are ever put into the situation to have a law enforcement officer read you your rights, you immediately inform him or her that you do not wish to speak to them, or make a statement, without an attorney present. By law, at that request, they are not allowed to question you any further. |

Your Miranda Rights. They do not have to read you these rights when placed under arrest. They only have to read them to you if they question you. When you get to the jail and you go in the little room and someone comes in and starts asking you questions this is when they have better read you those rights. Just remember though never ever ever say anything!! until you have a Lawyer present. Just give them you I.D. it has all the info. on it that they need. Keep Your Lips Sealed! Loose lips sink ships!!! |

It seems that all the answers are right, but do they know why? In 1967 A criminal named Miranda won an Appeal of his conviction, even though he confessed. He admitted to the crime after hours of questioning. He was not allowed to have a lawyer present/ He was not allowed to go to the bathroom, no food, no drink. Everything he said was used against him in court. After his conviction his lawyer appealed all the way to the US Court of Appeals. The Court decided that everyone has certain rights when arrested. Hence, The "Miranda Warnings".....You have the right to remain silent....etc,etc. |

with the coming of bush law aka the patriot act, you have no rights. police are no longer required to read you your Miranda rights. but that's what they were called back in the days of our innocence. of course that's all over now, never get it back. |
