I am the quitclaim deed owner of a farm in ohio. I have moved so I am not that close to the farm any more, I still live in the state tho. My father still lives on the farm and the deed says he has use of said farm. My father is up in years an it seams to me that he has been influenced by a man that he met here in the last three maybe four years. This guy I feel is a bad move on my fathers part. The guy had the nerve to tell me to stay away from the farm and not to come back ( he sed this in a voice mail message he left on my phone) I made a copy of message. So here is the question can i put a restraining order on this guy to keep him off the farm? I also would like to know if I can file a trespass charge on as well. I also thought i would put a restraining order on him so he can't come near me when I go out to the farm from time to time. Any help with this will be greatly welcomed. Thanks and have a great day.

Better consult a lawyer. A quitclaim transfers only whatever rights the seller has and makes no guarantee of title. It often transfers nothing. If it was effective to transfer a life estate to Dad with the rest to you, you have no current vested interest because there is no guarantee that you will live longer than dad. So, I can't tell if you have any interest in the property at all. That being said, you do have an interest in your Dad's well being. Talk to Dad. If he is competent to make his own decisions then butt out. If not, then get him a guardian. |

you have no idea what he is doing, but I can assure you, it is not going to be good...
either he is trying to adversely possess the land, (in which case, your or anyone's deed is irrelevant if the time expires), or he is doing something else devious.
#2, if your dad gave him permission to be there, unless you can prove your dad is incapable, then he has every right to be there.
So:
I would say, NO to the Tresspass charges, or the restraining order (to keep him off the property) w/o Dad's involvement/cooperation.
On your restraining order, has he threatened you with harm? (details please)?
Otherwise, it is not likely you will get one.
