My mom's friend has a daughter (Jenn) who has been having problems with a certain girl at her school. Yesterday on her way home from school Jenn was followed by this girl and her friend. She ran to her apartment but since her parents were not home and she forgot her key she was not able to get in. She then ran to her aunt's apartment but the only one there was her ten 9 year old cousin and his baby sitter. Before she could get into her aunt's apartment Jenn was caught by the two girls and they dragged her down the hall and started beating her up. What's worse is that one of the girls brought both her mother and father and they helped them beat Jenn up. All the neighbors heard and they tried to stop them but the girl's father is a pretty big guy and no one could get him off of her. With all four of them beating her they broke one of her ribs, broke her jaw, and left her bruised all over. The neighbors called the police but when they got there they refused to arrest anyone. Jenn's parents were called but the police just told her to file a complaint and that the people who did this can't be arrested. Jenn's mom called my mom for advice but she doesn't know what else can be done. I told her that she could maybe call the nearest court house and talk to a clerk and ask him or her what can be done. Other then that I don't know what to suggest. Does anybody here have any suggestions. I really don't know if this is the appropriate place to ask this type of question, but maybe someone here can give me some useful ideas.
P.S. The entire building was a witness to Jenn getting beaten and a lot of people caught it on tape.

I don't know if Jenn's mom omitted details, I'm just reporting what I was told.

She should get a lawyer and sue the girl and her family. If the police wouldn't arrest the parents then she should consider legal action against the police as well.
I know of a case where the police wouldn't arrest a suspect in an attack because he was a buddy and the victim was from outside the area. The victim sued and won in court. She also reported the police to the FBI who began their own investigation. |

It sounds fairly sketchy. If someone was beat up and it was caught on tape, then that is more than enough for probably cause for a Police Officer to do something.
With the severity of injuries the girl sustained there is no way in hell any Police Officer would just dismiss it and say "file a complaint". You are most certainly hearing the story incorrectly or details were omitted.
Regardless, if this all is true here is what you can do: Her parents need to go to the police station with the tapes and whatnot and file a complaint. Then follow up and make sure the other parties are being prosecuted. |

The police can not charge someone with a crime that they did not see. If there are video tapes, those can be used, but as stated in other posts, the charges have to be filed by the complainant or her parents if she is a minor. Again--the charges must be signed by the complainant when the criminal action is not witnessed by a police officer.
The police will then interview and get statements from the neighbors that were witnesses to the incident. From there the case will be given to the prosecutors office.
She can file a civil suit; however, since this is a criminal act, if a criminal report is not filed, many courts will not even look at a civil action. |
