What can police do if they find you with a used pipe?

It's probable cause for a search- they can search the residence, or automobile you're in, and anything you have on you, for contraband.

If there's no weed, though, they can't put you in jail. Being high isn't illegal, also- just possession of the substance is.

And to the people claiming they can arrest you for paraphernalia, not really- it depends on the state. I live in Texas (very Republican state), and I can buy pipes/paraphernalia from stores, so it's highly likely you can own a pipe in California.

Hubby, you're an idiot. I just looked on that website, and there's nothing to suggest you can be even arrested for having drug paraphernalia- hell, you only get 10 days in jail for having marijuana on school grounds, according to that website.

Nothing, if it was a MJ pipe. Possession of marijuana paraphernalia has not been illegal in California for at least 25 years.

In Florida they run a test on it...if it is positive you get a possession charge....if not you are still getting a paraphernalia charge.

Charge with posession of drug paraphaneola and search you for drugs and if they find any, charge you with posession of narcotics.

You can be charged with drug paraphernalia at least and possession at most if their is enough residue in the pipe.

If you are driving they can also demand a test of your blood, and depending on the results, charge you with DUI - Drugs.

TO Ze - they can not search a house if a person is in possession of a pipe, only the immediate area within reaching distance of the suspect. Also, anyone can be arrested for paraphrenalia, but most are released on a citation so not to clog the jail intake.

To Ze again - Possession of drug paraphrenalia is a misdemeanor charge that can get a maximum incarceration of less than one year (364 days.) Don't rely on websites for your info. Check the current statute books at the library.

Littering is a minor misdemeanor and I arrested a person for it because he was tweaking on meth so bad that it looked like he was vibrating That was the only charge I could use because he threw a beer can out the window of his friends truck. I took him to jail so he could come down off the meth under the care of our jail doctors.

They then have the right to search the vehicle (or person) for other narcotics. You can get arrested for it. Here is a hint though, DON'T DO DRUGS and then you won't have to worry about it.
