Final Sentence is determined by many factors.
1. Was your case a plea bargain? Then you would be sentenced to the terms agreed upon in the plea bargaining agreement.
2. Jury trial and sentence awarded by the jury's findings.(based upon jury's findings and recommendation to the judge-Judge can deviate from actual Jury sentence only by reduction not increasing it)
3. Judicial Sentencing maximum and minimum allowed
Indeterminate- max and min given with the parole board deciding actual date of sentence to be served
Determinate- Judge chooses specific amount of time to be served based upon crime, habitual offender guidelines, PO, DA recommendations. |

Depends on the crime, but I would say the main thing they look at is your past. If you have a clean record, you have way better chances of probation. If you have a criminal past, then expect the worst. |

Evidence, sometimes a jury, if he finds you guilty will consider prior criminal records, what your doing with your life are you working and being constructive, or not, stuff like that, and the severity of the crime. If you snitched or did a plea bargain. But there must be evidence. |
