If you touch him, it's assult on a police officer. They'er never "off the job", just not on patrol. and as you stated you know hes a cop.
Video tape him and request a meeting with a watch commander of the county sherrifs. Try not to use his department to report it, get others involved. Send a copy to the local news and watch everyone with a gipe against him start speaking up. |

Can be charged with assault to an officer off duty or not. Video tape his actions and file a police report go to his boss, get a lawyer, or call the news station to run a story. Just cause he's a cop doesn't make him above the law. I believe its against the law to dispose of trash on others property and kicking a dog is a form of animal cruelty. |

Most, if not all, states have an enhancement on a Misdemeanor battery that automatically makes it a felony if you batter a cop, EMS worker, School Teacher, and many other public jobs. I would guess you would be looking at a felony if he pressed charges. |

Don't do that it. It opens you up to criminal and civil liability.
Depending on where you live, you can sue him for coming on to your land, dumping his trash on your land, kicking your dog. Also, sue him for intentional infliction of emotional distress and possibly negligent infliction of emotional distress. These can all lead to money damages, especially the last two.
You should also seek an injunction and restraining order. |

People sometimes get confused with this.
If you were to start an altercation with me when I was off duty you could be charged with simple assault. Now 2 things must happen to make me 'on duty' ........I must identify myself as a police officer and I must take a police action. All I have to do is say " Police officer, stop" and if possible show my badge. Depending on the situation showing a badge may not be possible..By Saying "police officer, stop" I have Identified myself and have taken a police action by telling you to stop. Now at this time if you continue to assault me it becomes aggravated assault on a police officer.
By identifying myself as a police officer and commanding you to stop I have taken a police action and therefore I am now in the commission of my duties or 'on duty'. |

Yeah okay, but if your serious, since you already know he's cop or if a cop is off duty and identifies himself and you will be in hot water!
If you have civil issues with him, talk to him about it... If that fails, and you have a legit comlaint other than you don't like him or cops, contact his agency and make a complaint there. |

well good for you that you kicked his *** - most cops feel its ok to go around and bully people just cause they are cops and can at times cover up their dirty deeds.
He had no right to kick your dog and your only defence was that he was physically abusing your dog and you did what any normal dog loving person would do which is defend the animal.
I hate dirty cops - i have always wanted to be a cop and would rather get paid just to hunt down dirty cops like those that pick on innocent people instead of protecting them.
you need a lawyer though.

Report his activities to his superiors in writing. This will go on his record. And if he keeps up his activities they will suspend him. |

Most cops I know and work with would not do this. If the situation played out exactly like you described, a cop wouldn't want the headache of an internal investigation for a neighbor dispute, littering complaint and injuring a pet.
Therefore, I offer a few different scenarios...
Your dog dragged garbage into his yard and he was just returning it.
He was taking out his garbage when he was attacked by your dog. He spilled the garbage defending himself.
Your neighbor is not actually a cop and you are just spouting anti-police rhetoric on this site.
Maybe a combination of the three, maybe not. |

An off duty cop is still a cop. If the altercation takes place and can reasonably be tied to a police activity, you will get busted for assaulting a police officer. If not, you will get busted for assault. Not to mention, if he's a cop, he'll probably kick your butt. |
