About three months ago, myself a two others were dismissed from our bar job for drinking after a shift and breaking some glasses. It appears the owner of the bar has informed the police, on friday a PC phoned me and asked me to meet him at a police station this thursday to talk about what happened. Has anyone any idea what will happen once I arrive at the police station? am I being arrested? I have never had any dealings with the police and am beginning to panic. I am in Edinburgh, Scotland.

If you are requested to visit the local police station, then you are not under arrest. It is probably just to give your side of the story.
Unless they arrest you, then you are free to walk out of that station at any time. |

If you were being arrested they wouldn't have phoned to warn you!
They probably just want to have a chat and slap your wrist.
Might as well get it over and done with!

You will be asked to account for what had happened on that night.
It is likely that you will be interviewed, and therefore cautioned prior to this.
Remember, truth is the best policy. You don't know what evidence the bar will have provided to the police, therefore if you lie about something, or deny the offence, it will go against you at court. |

Erm, you may get into a little trouble as drinking after hours in a pub is illegal...
Could you say you were messing around and drinking pop? You asked your friends to stay with you while you cleaned the lines? They got a bit silly because they were already drunk from before and broke some glasses?
Actually, I shouldn't encourage you to lie to the police...that is BAD! BUT if it was 3 months ago, maybe it's about something else? Don't say anything until they've asked their questions. |

They''l want a statement so they'll read you your rights. Don't freak out. Ask them if you need a legal representative and if you are going to be charged. They probably won't charge you because the offence is so small and does he have evidence like CCTV? Also, he's made a complaint and they have to follow it up.
They may recommend that you reimburse him for the cost of the alcohol and glasses, but will they enforce this? probbaly not. He'll have to go throug a small claims court and it wiil cost him more if it doesn't suppport his claim.
Go to the Rozzer's, but be friendly and co-operative, and possibly cagey. It all happened so long ago, they're just following up his complaint. |

Just answer the questions but remember unless you are arrested the police can't take fingerprints or DNA, they may ask you and suggest that they have the right, but they don't and you should say no. |

Problem here is it Scottish law which is a bit different from English law.
In England, if the Police suspect the commission of an offence then they will have to caution you before questioning but they do not have to arrest you*. If they do not arrest you then you may leave the Police station, however this may not be a good idea unless you have resolved matters.
If they arrest you then they must follow certain procedures such as searching you. If you just broke a few glasses then I cannot see much happening, but if you dranlk a lot and did not pay for it then you may be looking at a theft charge (since you were staff and not public the drinking after hours would not apply)
*E.g Trading Standards and Environmental Health have to caution possible offenders but have no powers of arrest

I wouldnt panic too much if I were you, the incident happened too long ago. If it was such a big deal why wasnt the incident reported when it happened. Dont worry too much, people get away with a lot more serious stuff than this. Good luck. |

Most likely it IS just to talk about what happened. It's possible that, having talked to you, the PC may arrest you and charge you, but usually if you're asked to come in voluntarily and they feel this might happen they'd advise you to bring a solicitor.
It's clearly not being viewed too seriously or he'd have been around to see you at home, and if necessary arrest you there and take you to the nick for questioning. |

don't say anything just name.. address.. d.o.b ..then get a solicitor do not speak about what happened untill you get a solicitor REMEMBER SAY NOTHING gives police less of of a chance to twist things..ask what your under arrest for ..if you are not ask if your free to go ..if yes then leave don't let them manipulate you into talking about what happened |

yeah, if they question you about something they have to arrest you even if its something stupid that you wont be charged for, its procedure in order for them to be able to ask you questions about what happened. even if they tell you before to visit the station once you get there they do have to arrest you once you get there. dont panic its just their procedure. YOU ARE NOT FREE TO GO AT ANY TIME. that is wrong.
they put you in a cell like waiting room, take everything from your pockets to put in storage, ask you if youve ever tried to kill yourself and if so, take your belt. they you wait for ages while they bring you drinks and take your DNA and mug shot, then you wait for more ages. then you get asked if you want a lawyer, you say yes some lawyer guy on call sits and talks to you and says thats the silliest thing ive ever heard but if someone has made a complaint they have to follow procedure. then they ask you what happened and record the conversation and the lawyer takes notes, then you go in the waiting room again and they decide what to do with you and whether they will charge you for what someone accused you of or not and then set you free. |
