Maybe once you get back to the police station.
For all they know, you could be concealing a weapon, or using "getting dressed" as a chance to run off and evade arrest.
But then again, it all depends on the situation and how friendly the officers are. |

mikeysco has it nailed down. Clothes or no clothes boils down to three things: Decency, officer safety, and arrestee attitude.
Last Sunday I arrested a guy in his home while on a felony warrant detail. He answered the door in jeans only, no shoes or shirt. I handcuffed him, and had dispatch confirm the warrant. He kept begging for his t-shirt and told me he'd show me where it was and tried to lead me to it. I pulled him back, and told my partner to check out the t-shirt on the table. He found a large knife under the shirt.

even if you are completely nude, it is too much of a risk to allow this person to get him/her self garments. Some times if you are nice enough to the arresting officer he/she will go into your house and retrieve you some shorts, or if your being an *** hole they will just put a towel around you. It all depends on the officer, and if you are missing a shirt, or shoes, there is no way they will get you them, too much of a hassle when it is not needed. |

What civil right would it violate to not let you get a shirt or shoes?
You are being arrested, taken to county jail where you will be dressed in while you are being held. If your clothing is less that adaquate, you will be given a standard issue jail uniform to cover yourself with until bond is posted ( if you have a bond ) or until you get housed in the facility. |

Will depend on several issues, why you are being arrested, and the security of the situation.
for example if they come to your home with a warrant, and you do not have shoes or socks or even pants on, and there is a concern that there can be a weapon hiden in your bedroom around your clothes, or if you have put up a fight, they will not allow you to be dressed.
If you are polite and don't fight, often they will have a officer get a pair of shoes for you to pull on, and a shirt to put over your shoulders, ( normally you are already handcuffed so you can't put it on.
But normally at the jail you will have to put on the clothes from the jail anyway..
IE, there are no civil rights that force police to cause a security risk at allowing you to dress. If you are naked, they will normally have a sheet in in the trunk to put around you. |

Perhaps the person being arrested would like to take a moment or two to freshen up for the trip downtown? Perhaps a quick run-through with a hairbrush and spritz of gel; a short blast of breath-freshener so as not to "offend"...?

The general rule is, as a friend of mine on the Fugitive Squad says: "You ride like you hide."
There is, of course, the occasional exception. They usually will not let you get dressed, but they may grab a sheet or blanket and wrap you up, after you've been searched and handcuffed.
As to the legal aspects, it's a simple thing....show me in the Constitution where you have the right to get dressed. Officer (and public) safety becomes the overriding factor when someone is being arrested. |

If you're just missing shirt or shoes, you'll go to jail that way. You're going to turn in your clothing items anyway & be issued jail clothing, so it doesn't matter. I fail to see how being taken to jail without shoes would be in any way a civil rights violation. |

That is not their primary concern. It is more or less to get you away from the general public and question you for possible offenses. |

Get ready to freeze when you get to jail until you are issued an orange jump suit. If you have perscriptions, prepare to lose them also. When you are finally able to contact your family and they are allowed to send you flip-flops, and underwear, you may start to warm up. |
